PPI Claim failed
Recently I have put in for a PPI claim because I was mis-sold the policy. Basically I have an ongoing illness which is not covered (only just found out) by the loan insurance policy (from Lloyds TSB). During the loan interview the salesman DID NOT ask me if I had any ongoing or previous illnesses, he did ask me if I had any current illnesses to which I said no. The bank owe me £500 at least but I cannot prove what the salesman said (or didnt say), The bank states that the salesman must have asked it or he could not proceed with the loan. Well its just a simple matter of pressing "next" on the computer which I watched him do many times during the interview (which was rushed because I was on my dinner break and he had already made me 15mins late). What can I do?

Sorry I meant to reclaim PPI charges, I was mis sold the policy and wanted to claim all the payments Iv made up to date.

But you said no to having a current illness, I would have assumed an ongoing illness was exactly the same as a current illness.

So you had an 'ongoing' iillness at the time but didn't tell him as you were in a hurry?
Sorry but I think you need to take responsibility for that rather than splitting hairs over the definition of 'ongoing' or 'current'.0 -
hi gunn sorry to hear about that. when we are selling protection we need to ask do you have any health cond or have seen or even arranged to see a doc about any in the last year. (e.g. if you have high blood pressure and this is under control due to self medication - tablets etc) then this is still classed as a pre-ex cond. if you say no to this question on application for the protection and then if you try to claim at a later date and are asked if you have any conditions etc and you say yes and they(the conditions) begun prior to you taking out the policy then you won't be covered.
word of advice to anyone taking out a loan/cc etc do it over the phone. calls are recorded you can request the cd of the conversation at later date should you need to...unless you fancy taking in a voice recorder or videocamera to the branch?:rolleyes:0 -
Sorry chaps I havent made it easy to understand, I have had depression twice (in 2004 and then in 2006), I had been off medication since the end of 2006. When I took out the loan I wanted the "protection" incase I became ill again, which in the last 2 cases rendered me a bit useless for a couple of months and couldnt work. Would the illness be classed as an ongoing illness? if not then fair enough I havent lost anything, if so then I was not told of any time scales of what is regarded as an ongoing illness. I had only picked up on the get out clauses of the PPI after I read this site and then started looking through the paperwork. In heindsight I should have read through the small print but the advisor didnt give me anyreason to doubt what he said. I used a letter template from this site and sent it to Lloyds HQ, they just simply said in the return letter "he must have asked you as the system does not allow an advisor to proceed without asking you the specific questions". In reality the advisor just looked at me (im 21 stocky chap) and asked "any current illnesses i should know of?" to which I said "no" as I havent, he then clicked "next on the computer and didnt ask if I had any previous illnesses within any time scale. Im not trying to pass the blame or anything as I know I have been very stupid but being quite a neive 20yr old who wanted to spend the money on a car I put my trust in the advisor who now appears to have ill advised me. I was simply asking advice to whether I can take this any further or am I flogging a dead horse?0

If I can just summarise - please correct me if I'm wrong - you wanted the PPI in the first place just in case your illness (or any other) reoccured.
As far as I can see you have not made any claims but you now want a refund of the PPI - because you think that it will not pay out?
Is that correct?
If so then there is no missale here.
You get enough time to read the policy document and you answered the question about health correctly.
I think the policy will pay out if your medical situation came back and you had not been under the supervision of a doctor or on medication for a period of at least 12 months before you took out the insurance.
As you told the advisor that you had no current or ongoing illnesses then you gave him no opportunity to ask further questions or refer your case to an underwriter to see if they would cover you.
I don't think that you are naive at all - pulling a fast one maybe.
By all means cancel the cover from now on if you really want to (or you have checked that it does not cover you) and they will pay back pro rata the cover still outstanding but they will not backdate it to the start of the loan.0 -

Is there any need for that comment? I thought this was meant to be a friendly non opinionated forum?
I was simply asking advice, im not trying to "pull a fast one" at all. I wanted to know if I was mis-sold the insurance and what I could do about it, it would appear I was not mis-sold it and as such will keep it as it covers me (as long as its 12months since an illness). It was this site that put me in doubt to whether I was covered and as such I thought it would be a good idea to ask advice here!
