I have a similar situation with Capital one. I went flat broke last year when my employer didn't pay me and couldn't even pay the minimum balance. The charges on my card escalated even though I tried talking to them and the debt is now £600 +, regardless of the fact that my maximum limit was £200.

Having failed to negotiate anything with Capital one they have now referred it to a solicitor and I have written to them in accordance to the info on https://www.bankchargeshell.co.uk and I'm awaiting a response.

I will happily pay the money I borrowed on the card but not more than treble the balance!
  • What do i do if someone actually turns up at my doorstep with a court summons by the way guys?

If it is an officer of the court / process server ( they will have I.D ) then you have little choice but to sign the attendance order.

You could just hide, but all they will do is just post it through the letterbox and this is deemed to be served. N.b ( people have been know to tape up letter boxes ! )

However if it is just some chancer from a DCA then you can feel free to ask him / her to leave in whatever way you see fit.

Would be interesting to see if you do actually get a visit, if not then you have a strong case to take forward for intimidation / breech of the OFT guidelines

    Keep us posted
 It’s hard enough remembering my opinions - without remembering my reasons for them
  • Well, Tuesday has now passed, and NOONE came to my home yesterday! And noone today!

So i dont know why they said that, apart from to scare me (which it did lol)
