Did you know if you have a loan from the social fund when you are on benifits , you can include this in youre bankruptcy.
BUT:eek: :eek:
the goverment (works n pensions) where the loan is from are entitled to ask you to pay it back after you are discharged.:eek: :eek:

i was wondering what other peoples views on this are

1. The goverment benefits agency can claim back social fund loans after discharge
2. Isn't this the point of bankruptcy We can afford to pay!
3. Other creditors cant claim anything off us when we are discharged from bankruptcy
4. Is this one rule for creditors and one rule for the goverment
5. Is this fair?

    Hi loulou,

    That's pretty much the same as student loans not being included in bankruptcy. I haven't really got any strong views one way or the other.

    It seems a bit pointless to save money in that way, when the government is wantonly wasting so much taxpayers money in one profligate initiative after another.

    well i dont know what to think Im not allowed to pay it back during my bankruptcy but may or may not have to afterwards. But then again knowing this goverment they WILL want the money.
    Student loans are the same I suppose they help you out when you realy need it.

  • Social fund loans as long as they aren't taken out fraudulently are included in bankruptcy or sequestration in Scotland! there are some debts which aren't "provable debt" and so not included but there is case law to support this, I suggest you seek some help from an advice agency and get them to dispute this for you.
