CapQuest sent me forms for Stat demand for BR

CapQuest have sent me a Stat demand form for BR this morning on behalf of Halifax. I haven't even heard of them before never mind got anything prior to this letter. Can they just go straight for the kill like taht of are there steps they should follow? what am I to do? I really don't want to go BR if I can help it. What sort of payment arrangement are they likely to want for £1300 as i don't have much spare plus I have a Personal Loan with Halifax, will CapQuest have this debt too? that will probably be around £6000. i have other debts too.

    Its highly unlikely they will make you BR its most likely a scare tactic.

    alternatively contact our insolvency department immediately on 0870 084 2565 quoting ref: XXXXXX, where you can discuss the best option available to you and stop this process.

    In addition if you have access to the internet you can go to the government website, "Guide to Bankruptcy" vy logging on to:

    We trust that this can be resolved without the need to proceed to the bankruptcy stage.

    Have you tried contacting them to find out which debt it is? If it gets abit icky you are perfectly in your rights to end the conversation by saying you are going to CAB for advice.

    Just did a search,they are just another DCA-employing very harsh scare tactics it seems. Surely you have had some contat re an unpaid debt?

    It costs them silly money to make you bankrupt - more than this particular debt is worth so its highly unlikely they will take this course of action as they will not get anything back.

    However, if you want to avoid BR then sort out the debt on the off chance they are serious. Are you currently paying Halifax anything? There is a template letter on the boards somewhere about them proving Crapquest are entitled to collect this debt - as Halifax should have written to you to tell you. And its no given that they have your other debt with Halifax either. Call Halifax and ask them what they have done with the debt - would not usually suggest phoning but you need to sort this quickly.

    Get an SOA together with an offer of payment. It does not matter what they think they want (they will want it all in one if they could!) you need to offer what you can realistically afford and maintain.

    SDs can be sent by anyone and even though they are issued like confetti by some DCAs, they should never be ignored.

    Please speak to NDl or CCCS as a matter of urgency as you need to sort out the paperwork.

    If you post on the DFW main board, people can refer you to more information as well.

    And as a "defence", the fact that you do not know what the debt is about if perfectly reasonable.

    I NDL prove it letter would be a good start.

    It costs them £1500 to make you BR so is unlikely but not impossible. but as Ras says ring NDL and also post on the DFW board.

    Crapquest are well known for this. It seems that as they have immediately gone for the kill then it is probably just a scare tactic but it should be taken seriously just in case. There are some experts around who can help in more detail with these. Hopefully they will be along soon.

    In the meantime, perhaps send them a CCA request which may delay it. They will have to prove that you owe the debt then.
