hi
well i have finally got my date to go to court-22nd july.I rang up last week after taking 5 hours to pluck up the courage!!!I now feel a mixture of strange excitement at finally getting rid of all this debt to oh my god am i really doing this?????I have spent the last week dodging phone calls(caller display is a wonderful thing!!!!!).
I am now working through the forms and would really appreciate some answers to my really stupid {and they are,i am sorry)questions.
1.question 3.9 use of motor vehicle do i put my husbands car?am i going to make it harder to plead to keep my car??
2.5. cards do i put cards that i actually have on me??i have 8:eek: :eek: credit card accounts but most of the cards have been ripped up so do i just put the ones i have or do i have to list all 8 plus bank card??if i do i have not enough space so where do i list them all??also date obtained-is that the date i originally got the card or the start date on the card??
8.2 and8.4 property i rent do i just repeat the information on 8.4 as on 8.2??
does any one know when i start pleading about the car?!di i put a letter in to the or when i send all my other stuff or do i just wait for the interview i have 4 kids so have a people carrier i dont think i will be allowed to keep it but i do live on a road that is classified to have "an unavailable safe walking route"so whether this will help i dont know.
finally....have just read another thread about dca turning up at someones house and am now petrified i have only missed payments since the start of this month and go to court next week in all 22 days are they likely to turn up at my house???
anyway thats it if any one can help with any of my questions i would be really grateful sorry to sound like a rambling fool i'm not really honest!!

If the car is in your name then i think yes you should mention the car and i guess you will also have to do this if its joint names. Just remember that if you are going BR alone then its just assets that are yours that the OR will be interested in.
Yes put down all the cards. I had the same problem as you but list them all down and then the OR will have the complete picture. If there is not enough space just add in a piece of paper and just mention that to the BR Clerk.
What does question 8.2 and 8.4 ask for?
Basically if you have to plead about the car it will be to the OR after you have been to court but im sure you will get loads of advice before even getting to court off here.
I dont think you will have anyone turning up at the house over one payment i think things would have to go on for quiet a while so dont worry about that.

If you have use of your husband's vehicle, then yes you would put this down. Hopefully it shouldn't affect your plea to keep your own car, as he obviously needs it for getting to work, etc. We had to put down each other's cars and are waiting to hear whether we will be exempt for either of them.

You put down all of your cards - get the account numbers off your statements - basically anything you owe money on. Date obtained I put the date I got the card.

I faxed a letter through the morning of my OR interview (7th July). Waiting to hear whether allowed to keep it or not.

I would doubt it - please don't worry, it takes time before it gets to that stage, and if you are going BR on 22nd then you should be ok.

2.5. cards do i put cards that i actually have on me??i have 8:eek: :eek: credit (are you sure this is question 5.2 as on my SOA it's section 4 list of unsecured creditors??? ? 2.5 is about business partnerships

You should have extra sheets with which to put anything down. If not can you print some off the IS website. Yes it's the date the accounts where opened. If not sure just give a rough date

It usually takes a while for the creditors to send people round

Hi mumoffour i want to wish you luck on your br hun, i went to court yesterday the 15th july,i worried all week and worse the night before but to my amazement it was a walk in the park.I got there at 9am, reported to the usher, sat in waiting room for about an hour,went upstairs to see the clerk, went over the forms with him (lovely guy btw lol ) he then said i wouldnt need to see the judge and as soon as judge has checked my forms he will call me back.Paid the money and swore the oath.Went back to the waiting room for another hour and 3/4.(longest morning of my life) he called me back at 12 noon and gave me my paper to say i was br.Didnt need copies of bankstatements or the br forms.It stil hasnt really sank in yet!!! Had call from O R at 2.30pm today, 10 mins on phone to go over a couple of things.He filled me in on what happens next and thats it so far to date.

thanks for your kind words-i feel really strange at the moment i was quite positive but as tuesday draws nearer i feel a great sense of dread ,especially after reading summers experience of the or!
I have decided to be honest about my husbands vehicle it is a truck that he uses for work,at the end of the day i can drive it but rarely do as there is'nt enough seats for all the kids!I am sure the or can check up on all this sort of thing so i want to be seen as being truthful.I do think i will lose the car,it's worth about £4500 i do live on a really dangerous road with no pavement so walking will be a nightmare with 4 children, i know the or will sometimes negotiate with you to have a relative buy back the car or release funds so i hope maybe they will do this.

the truck is in my husbands name the people carrier is in mine.it's q.3.9 on the form about having use of a motor vehicle you do not own.

TBH i would not mention DH truck as it's not in your name. You will have to mention the PC though. They do ask what vehicles you have registered at your address anyway as they check with dvla,as i had to tell my OR about my daughters car.
