How does this square with legislation. If you go to a shop and buy something they are not allowed to stop you at the door and say it is mispriced give it back to us. Surely if you go online and pay for goods they are sold??0

I believe (correct me if i'm wrong anyone !) that they get out of it by saying that it's not a 'contract' until the goods are actually delivered to you, even if you've paid for them and the money has come out of your account.

A number of similar deals have ended up in this scenario. IIRC the shops are within their right to do this, but sometimes don't for PR purposes, but when they are talking about a 90% (or is that 1000%) misprice I guess they feel they can't afford to.I think I saw you in an ice cream parlour

Yep, this is correct. You would need to check the terms and conditions on the M&S website to be certain, but many online retailers deem the contract to be formed at the point of delivery, not confirmation or payment.
Even if the contract has been formed, they could also decline to deliver because it was an obvious pricing error.Gone ... or have I?0 -
With a product price differential of this size (i.e. over £350 compared to the price elswwhere), you could always sue for loss of bargain in the small claims court. I doubt very much whether M&S would take it all the way. I won't be, though. You win some you lose some.
PS They DID say 90% discount IIRCso it could be argued that it wasn't an obvious misprice..Call me Carmine....
