Redetermination Pending

Hi Everyone,

Im beginning to get a bit nervy now, Court date is looming 29th July, I have a DMP with Payplan but quite honestly its sometimes difficult to communicate or get a clear answer, Ive found the UK debt line really helpful, they quite often email back any queries I may have. Out of my DMP only 2 of my 10 creditors refused my payment offer, these being Nationwide BS, both the accounts have been transferred to my local court for redetimination, I have offered NW £50 per month both debts amount to about £7.5K so a total of £100, they wont accept anything less than £99 for each account which I really cant offord. My current DMP pays out about £50 between the 2, So O haev tried to increase the payments but they still dot accept and progress through the courts? Has anyone been in a similar position? Is the court likly to accept my offer of £100 which is still more than original.:confused:

Another question around CCJs, these 2 accounts have been issues CCJs which is why Im attending court? Its says these remain on your file for 6 years, what happens if after 6 years the amount hasnt been fully repaid still and you still have to pay for instance for another 2 years? Are the CCjs removed? Juts a query as my mortgage deal is due to finish in 8 years? just thinking ahead???

Just another :confused: question, if at some point in the future say I win the lottery for £500 can I just add that to my DMP for the month, then resume normal payments the next month or wuld this confuse the creditors? Just thinking of any potential possibilites of getting the figure down, well you never know:idea: and also Im planning to submitt my Credit card reclaim forms to the bank after the court date, so that if I do manage to get the £££ss back for charges etc I can put this money against my debts too... hopfully

    I think the courts would probably accept what you can afford to pay. They will probably accept what you are already paying through Payplan.

    Re paying more one month - I was advised not to do this as creditors can get nasty and will expect more every month. It's probably best to save the money so that you are in a position to offer a full and final settlement instead.

    If you are successful, they will take the amount off the debt you owe them anyway. Good Luck x

    It's probably best to save the money so that you are in a position to offer a full and final settlement instead.

    I agree. Save the money. DMP's don't really give you an opportunity to save, so put it away for an emergency.

    Thanks much appreciated advice, if I am lucky enough to win any Lotto be it even small Il put it aside, I thought that might confuse the creditors and thats the last thing I thing I need...

    Thanks, If Im sucessful at least that reduces the overall? :T which is the main aim.....

    Hi Everyone

    Thought I would update you all with the outcome of my two redeterminations... Pretty Scarey day had no clue what I was letting myself into but heh no choice in the matter:confused: As I had 2 redeterminations 2 solicitors turned up (ugh) one was a real meany and basically before the hearing told me that they wouldnt budge and wanted the whole amount. Attended the court very nervous with Nationwides 2 solicitors, they presented there case i.e. they wanted there ££ The judge who was a very nice lady advised me and them that she was very impressed with the work put in via 'payplan' and could see that I was trying to address the situation and that I & payplan had put together a good package in defence and she agreed with the amount payplan had suggested orginally that NW had declined.. at the end of the hearing she did say that in this day and age a lot of people are struggling and that we needed to be mindful of that, and as I was leaving wished me 'Good Luck':j

    So a Big thankyou to 'Payplan' although Ive moaned about there skills at times I owe them one and the nice lady judge . After 8 months (start of my DMP) I am just nearly relaxing a bit, but this does teach you a serious lesson about money, you need to be careful always as you never know whats around the corner,,,, unless of course you win the Lotto, which over the past few months I havent been able to afford but hey Ive still got a roof over my head, paying my bills, and a little less stressed, maybe this Christmas I may be able to smile as last year was horrendous worrying !!

  • thank you holly for sharing your experiences i only hope i have a similar experience when we go to court next month for a redetermination heraing then a co hearing for the smae debt on same day! i am desperatly hoping that we will get a lovely judge that will see we are paying the most we possibly can and that they will throw c/o out the window as we are doing all we can and are paying regually etc!agghh!so scared!but heraing your story makes me feel like maybe, just maybe we will be ok!

    I know how scared you must be feeling, Id never been a court before, and i thought it was just going to be a small office like room? Mine wasnt it was in a mini court, I went alone as I hadnt told anyone about my plight apart from the MSE board as I was too ashamed, So I was a bit wobbly!!! but still the first solicitor got me a bit cross with her attitude (who did she think she was) , so although I was shaking in my boots i thought I have to get my point across, I am trying hard to get myself out of this mess and heres the evidence I work hard and try my best but Im a single parent and Im struggling (although I didnt mention the single parent bit) , by slapping a charging order on is not going to benefit anyone, but I think even if they do you can ask the just if it can only be for security reasons i.e. if you default. The judge Ive been told is usually sympathetic and theres no real point in forcing a sale if you have other debts... So Good luck, be polite to the nice Judge and hopefully yu will have a great day...
