Euro rate affecting annual fees-can they do this?

My friend and her family are members of Club La Costa Vacation Club (from what I understand similar to timeshare but not- all holidays cost points) and she has asked me to find out if anyone knows if this is legal.
The company have sent a letter that due to Euro fluctuations against the £ , the yearly management fees (sent in December) are not going to cover the costs of this years fees and they are now asking members to make up the shortfall by sending £60 . My gut instinct is tell them to stick it, as she didnt get any reduction when the Euro was trading high, I just wondered if anyone else had come up against this situation and what they did.
I am seeing her again tomorrow , so any questions etc I will pass on together with any advice .

    Suspect their management agreement will have a condition which allows them to recoup shortfalls caused by a drop in the value of the £.

    Get her to read up the agreement and see if this is mentioned.

    How do you pay?
    Is it an Euro amount or sterling.

    If you pay in sterling I have a feeling that you will have to pay up.

    If you pay in Euros you are already paying more because of the rate to buy the Euros.

    I can vouch that they can do this. There are clauses in the Terms and Conditions that clearly show it. I run a Members website at www.clcmembers.co.uk and on our own forums, we've had owners cite the regs. If anyone gets an invoice and is a paid up member in the current billing year, then you will have to pay or face legal action, just like any other product you must pay for. Its a tough one and Diamond Resorts Owners recently had to pay the same roughly 10% increase. I understand around 1000 of them left the club.

    If you are going to leave make sure you are paid up before handing in your Points Certificate and you send it recorded delivery in time before you get your next bill. There are a lot of unhappy owners we know that from the 2500+ registrations we have, but the AGM is in October and the Elected Member Directors are gathering points to bring up at the meeting. Contact the EMD, is my suggestion and let them know your feelings. Club La Costa published their information in last years minutes. Contact Club La Costa also, if for nothing else other than to vent your feelings!

    Thanks for your replies- I will print them off and show them to her.
    I expect this weekend her and her hubby will be reading through the contract ,but if they can do it ,then she had better bite the bullet .
