Too late! I have already gone to the post office and sent the letter off - had to send today as their payment they've asked for is 12th!
If they come back with here is your signed agreement, I'll do what you suggested with the payment date.

Just an update on this. I sent my letter on 10th July, and have tracked it online & saved the signature page on my computer.
I haven't heard a thing back from them.
What do I do now?

I had been on a Capital One Payment plan for a year. My balance has just gone under the actual original credit card limit - which to me is proably the reason why they sold it.
Can anyone give advice on what I do now? Is there a second letter or what?

If you do not receive a copy of the true signed Consumer Credit Agreement within 12 +2 days , the account is in dispute . I have not made any payments on three accounts since Nov last year !0

ITs your debt you should pay it but if you choose not to, follow the rules and send the next letter then hope they don't find the CCA.Barclaycard 3800

Earlier this month I wrote and increased my payment slightly to all my creditors (including a budget statement). No problem for any of them except Capital One. I've got a letter asking me to call them to talk about the offer.
They either have a problem with the amounts I have down for housekeeping and clothing - which happened last time I tried to increase my payment to them. However, this is the same as it's been for 2.5 years now - even though the cost of living has increased.
The other thought I had was maybe I'm at a level where I should return to paying the normal repayment each month. Two of my other debts are there and have started adding interest again.
We shall see.
GoldenJill - I'm sorry but I don't know anything about the CCA rules but hopefully this will bump the thread up so that somebody will see it.
Gem - I've been on an arrangement with them for 4 years (although they would say only six months because every six months they tell me I'm off the arrangement and have to set it up again)
Just an update. I rang Capital One and they wanted a bank statement and copy of a payslip - which I sent. I've just received a letter from them (after three weeks) which says that before they agree to my repayment they need a breakdown of my creditors showing how much I owe them and how much I'm offering to pay each one.
I'm really cross about this because I sent this to them back in June which prompted them to ask for the bank statement and payslip.
My guess is that they're just stalling whilst they're selling my account on to a DCA. Has anyone else had this treatment from Capital One?DMP mutual support number 174Total debt now (April 10) £0! - total paid off £30,221 or 100%I'm now debt free after 6 years!!:jNon smoker since June 2006 :j0
