I hope they aren't otherwise a tenancy has been created and freddiesgold is now a by default landlord - and probably breaking about 10 laws in doing so!

I am a Mortgage Consultant and don't like to be told what I can and can't put in a signature so long as it's legal and truthful.

Yeah bound to be loads of problems with this.
You're their landlord. They can stay as long as they want now as long as they pay you rent. How much rent? Well none.

I'd take proper legal advice. You should have told your solicitor at the start what you knew.

You got a gas certificate for your house?

I'd be really scared if I were you. If there is a fire due to a fault with the electrics or gas and one of the children dies, people are going to start asking who the landlord is (and looking to put them in prison).
I think you need to get good legal advice very quickly.

When I sold my house my solicitor was very careful to issue dire warnings to me as to what would happen if I was so much as one hour late leaving after the handover date. It was a whopping amount of money charged at an hourly rate and I would also have been liable for hotels, rearranged movers, storage for furniture.

I think theyve got off pretty lightly tbh!

The more I think about this one, the more I think you're in real trouble here. If you've agreed that they can live in your house in exchange for a cheque from the housing company, I think they're probably your tenant. Eeek!

I am not a lawyer. You're in serious need of one. And if you get a cheque, I wouldn't cash it without speaking to a lawyer first.

The VENDOR ie the housing company is at fault here. They completed without checking that the property was, indeed, vacant. I suggest that they move the family into temp accomodation asap. You can not possibly allow this situation to continue without potentially giving yourself a whole heap of trouble! Let your solicitor handle it (do NOT talk directly to the housing company) - or get a better one if you think this one let you down - and claim all expenses back from the housing company.
