Surely if the courts wanted to be entirely pro-active about getting consumers their dues back, they could order the airlines to write a letter to all passengers that flew during the period in question informing them of their potential right to some form of refund?
Why advertise on TV when the customer list of those affected is no doubt quite clearly recorded.
They could even use the same letter to apologise.
The TV medium seems quite wasteful and inefficient, though does well to discredit the reputation of the airlines involved.

I registered my claim some time ago and have now had a letter from the lawyers dealing with it. Although the letter says that £73,531,076 is available to qualifying UK claimants, it claims payouts will range from £4 to £20 per customer. Presumably that's how they're funding the ads.
It's also worth noting that although in the US any unclaimed funds will go to charity, no such arrangement exists for the UK so presumably the airlines will keep it.TRC0
