Hi Guys
My cousin has recieved a county claim form for a debt she has with MBNA....now she's only got until tomorrow to get the form back (she's admitting it but wants time to pay) if she gets this form back to optimalegal will this automatically mean a CCJ or if they accept her payment plan and she sticks to it will there be no ccj?
really appreciate the advice!

There will be a ccj unless the balance in full is paid within 30 days (I think, could be 28). If this is paid in full, the judgement is set aside and will not show on the credit agencies.
If not paid in full, and then subsequently at a later date, the ccj will be shown as satisfied.
TBH it really is best to try and get it paid in full. In today's market trying to get credit, mortgage, bank loan, car finance etc is near impossible with any adverse information.

I had a silmilar thing with first direct, phoned DCA and was offered a consent order. Don't know the complete ins and outs but I think as long as I pay the specified amount each month it doesn't go to a ccj. I'm sure someone will correct me if I'm wrong.Why didn't someone kick me up the backside earlier:mad:
