Hello ~ back again. I got a call from Westcott Financial Services today asking for the OH. When told he was at work the company told me they were a debt collection agency ~ they had absolutely no way of knowing I knew about the OH debts. Is this allowed? The OH has had nothing from anyone saying a debt has been sold on ~ any ideas?
The court order went crap ~ OH ordered to pay £352.00 per month for a £2202 debt ~ this is more than double the total monthly amount paid to Payplan ~ so much for the court staff looking at SOA! Have applied for re-determination and hearing and are still waiting date.

What is the back ground to the debt ? Did he attend the hearing did they supply a CCA , was it defended ?0

Hi Stapely ~ debt is one of the OH's MBNA accounts ~ credit card ~ been passed from pillar to poast via varying debt collectors etc ~ Restons took it to court ~ Payplan sent everything to the court ~ SOA's etc (I know, I knnow, he should ahve done it himself) and he got back the judgement of £352 permonth~ which is just totally out of the stratosphere in terms of him paying it. Applied for re-determination ~ resent all the SOAs/covering letter etc (did it myself this time) and are still awaiting heraing date.0

Recently I received a letter from Wescott Financial Services, stating that I owed BT £200. I was with BT whilst living with my partner at a previous address, however I left the address after two month and contacted BT to tell them I would no longer be residing at the address. Two years on, I have received this letter. When I spoke to Wescott Financial Services, they said the debt COULD be an outstanding termination fee?

No MM it is most definitely NOT allowed. :mad: :mad:
In addition to being in contravention of the OFT Debt Collection Guidelines - http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf - it is against the terms of the Data Protection Act and, therefore, illegal.
At best, these people should be reported to the OFT.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

this has happened to my parents, a debt at my old address has been sent to my parents address looking for payment from westcott financial services. how do i report them to OFT. ?
2.8 Examples of unfair practices are as follows:
a. sending demands for payment to an individual when it is uncertain that
they are the debtor in question, for example, threatening debt recovery
action to 'the occupier' or sending a payment demand to all people sharing
the same name/date of birth as a debtor in the hope that contact with the
correct debtor will be made.
b. disclosing debt details to an individual when it is uncertain that they are
the debtor in question, for example, disclosing details to 'the occupier' of

Just wondered if anyone had received any letters from Scot Call for a debt that is not owed. We received a letter saying would send someone to the door. My hubby noticed they were part of Westcott Credit. Just a warning for anyone.
Incidentally every time Westcott try and contact us in whichever way they choose to do, they have actually PHONED!!! a neighbour to check that we are still living at our address - surely that is illegal?? The first time they said they had some letters from an old address for me and the second time they told the same neighbour they were from Parcelforce trying to deliver a package.
We called re the Scot Call debt and they said the account was now closed after tell them we had already sorted this issue 2 yrs ago with another company but it's obviously been sold onto Westcott, but I am worried now that WEstcott will keep bombarding us with this for ever. How do we get rid of this awful company???0
