Can she get this money back?

I wonder if you can help me here?.......
My mother did not have a bank account a few years back for various reasons. I then discovered that she had been keeping her savings in the house- around £10,000 in fact. When I found this out, I told her to put it in the bank. I later found out that she put it in my sisters bank account.
The upshot is this:
My mother had fallen out with my sister and has not spoken to her for over a year. We have both tried to contact her by emails, letters etc to arrange the return of the money, but she won't reply, other than saying 'I'll think about it'. Is there any way we can get this money back? And if she has spent it, could we sue her to reclaim the money?
We have no proof that it is/was my mother's money, but then she has no way of proving how she earned it.
Please help.

I'm not sure she would need to prove anything. Presumed innocent until proven guilty and all that.
She has money, someone else says it belongs to them, then they have to prove it's theirs.
I would go down the diplomatic route before starting a legal fight.0 -
I've tried the diplomatic route, but she doesn't respond, only to say 'I'll think about it'. If it was her money, why would she say she would think about it?

Could that be evidence?0 -

Only if you have it in writing or independent witnesses.
You could trying writing to her, she may write back and provide evidence to support your case.
Unfortunately, if someone owes you money, you an only make them pay it back if you can prove they owe you the money.
May people have send debt collectors packing simply by asking them to produce the original credit agreement. Often they can't do this, so can't enforce the debt.0 -
Could try the old trick, e-mail her saying "when are you going to pay back that £20k you owe mum?", she (hopefully) replies saying "F-Off, I only owe Mum £10k", and you have your proof.0
