Fredrick Int - Letter before action rec'd today!

Oh dear, seems i;ve not been quick enough, this morning have rec'd letter demanding payment within 7 days or immediate action will be taken & they've kindly shown me how much extra will be added on if they decided to take it to court! Hmmm sure this is a scare tactic and I've not spoken/corresponded with them yet as only found out they they've taken it over last week so they may think i'm ignoring it but i'm not.

Ok is it a good idea to ring in these circumstances? Only going to tell them a letters in the post so it doesn't look like i'm ignoring the issue.

    Yes, do NOT speak to them on the phone. Do you want to know what this debt is for. Have you sent a letter off to them requesting a copy of your CCA. Consumer credit agreement. Do this for now. Keep everything in writing. If you can let us have some history and background to this debt it would really help so we can advise you what to do. If at all possible we can try and the debt put back to orinal creditor. Then you can make an offer for what you can afford to pay. It worked for me hun. x x x x x

    I think you are right in that it is a scare tactic, especially as this is the first letter you have had from them.

    I would just send the letter you intend to send, recorded, and leave it at that.

    Try not to call them as they can be bullies.

  • Thank you everyone for your replies. I know what the debt is for, has just been referred from Capital One (who were complete pains when i started on the token payments, the only ones to keep adding interest & charges and ringing constantly to go over the same things!!) I received an initial letter from them end of last week saying they had take over debt and have been trying to sort out how to respond when this letter arrives.

    Received a few phone calls, one i answered and wouldn't confirm my security details as didn't know who they they were at that point (and he just couldn't understand why i wouldn't give a random stranger my personal details:confused: )

    So basically i know about the debt, have rung c1 to confirm that these people have got this debt and they confirmed it so don't think cca request is an option really as i don't want something to come back and bite me on the bum so to speak when I'm fully aware what its about??

    Irang CCS when i received the 1st letter who advised me to do what i did with my original creditors a few months ago and send letter advising that can't afford more than token payments & maybe i/e form to confirm this. Haven't spoken to them about this letter yet. Also should i send a token payment with it (ie postal order) as july payment for what was c1 debt is due now. Not sure if good idea to send cheque with sig/banking details if these people are as shifty as they look to be?

  • Meant to say that the initial letter was from FI not Capital 1 just in case it doesn't read right! Letter before action was 2nd piece of correspondence I rec'd from FI in matter of few days.

    Have done my letter to them & Income/exp so just wondering if the postal order is the way to go?!?

  • postal order is defo the way to go then they have nothing with your signature on it cos shifty companies lift your signature from stuff so dont sign any letters you post instead print it eg A N Other

    I think they're thick more than shifty - before I started reading here again I sent them cheques and signed letters. I then asked for the CCA and they haven't had the cunningness to go back and magic one up from what I've sent them. Either that or they just bin everything they get sent.... But a PO is probably the way to go.

    Ok hun, If this debt is to Cap1 and it has been passed over to a DCA then more likely you have a fair few over limit or late payment charges on it. HAve you checked your statements. These can all be claimed back from CAp1. What was your credit limit on the card and what is the debt amount now its been passed over to FI. And yes you can send a CCA. They will ot have it and it will be passed back to Cap1. This is exactly what happened to me. I then reclaimed all my charges back from them and they ended up owing me an awful lot more then i owed them. And i got every penny back. x x x x x
