  • Explain the situation to the insurance company and get them to issue a cheque in someone else's name or to have it credited to a deposit account of his own electronically. ie a b/society account.

Ask the trustee in bankruptcy to cash it for him!

Definitely no expert here, but we all like to think we pick up a few things on the way. If the incident that gave rise to the payment from the insurance company occurred before he was made bankrupt then the cheque forms a part of his bankruptcy and has to be passed on to the trustee in bankruptcy. Your husband will not see a penny but his creditors will get a bit each.
If the incident happened after he was made bankrupt the money could rightfully be his but how come he still owned his own car and was insured?
I imagine cash converters etc will do this at a price but if there is anything dodgy about his right to the money the blame, and the jail sentence will fall on your husband.
