CSA sent my information to his ex! What to do?

Hi,

After your sound advice on my last thread

http://forums.moneysavingexpert.com/showthread.html?p=10840469#post10840469

I'm back for some more help please.

As I had no option (they told me they wouldn't include any provision for my kids if we insisted on a voluntary arrangement) I gave the CSA my details (bank etc)......which they've promptly sent twice to the mother of his young baby!

To say I'm livid is an understatement. They also managed to set up the payment amounts wrong - I got the payment for 1 child and his other ex got the payment for my 2 kids. They're telling me that I wont' get the difference until next month - now I can afford to get by until then, but why the heck should I.

I am seriously, seriously considering withdrawing my claim for maintenance and letting them work out what he should give her then just getting him to give me anything left over. I really don't want anymore of my information passed onto to her - so far she's got my NI number, my new address, my phone number, my employer, my bank details and the amount he is due to pay me.

Is there anything I can do about this? Anything at all?

Massive breach of the data protection act. The tabloids would love it. ;)
They say it's genetic, they say he can't help it, they say you can catch it - but sometimes you're born with it

The incompetents at the CSA did something similiar to me. Complain to the office dealing with your case, your MP and also write to:

The Child Support Agency Data Protection Unit
    DWP Benton Park View
    Longbenton
    Newcastle upon Tyne
    NE98 1YX.

By passing on your NI Number and not keeping it confidential they have left you open to the possibility of all sorts of fraud. Under the Data Protection Act they have a legal obligation to keep your personal details accurate and up to date. Failure to do so is an offence. Start Kicking Now.

I agree this is a huge breach of data protection

There is a precedent for claiming compensation which can be found at http://www.ico.gov.uk/upload/documents/library/data_protection/introductory/claiming_compensation_2.0.pdf

Start with your MP and complain like mad!

Thanks for that. I've emailed my MP and MSP today re the Data Protection. I'm abso-bloody-lutely fuming!

On the practical front is there anything I can do to get them to sort the ball-up with the money? It's not something I need desperately, but given I've had her round at my door showing me the shoes she bought herself with my money (her words) I want it taken back from her and given to me asap!!

It it wasn't for the fact she'd get more money I'd tell them to forget it and say I didn't want any bloody maintenance.

You have nothing to lose with emailing the Newspapers - perhaps it might make the CSA take better actions in future.

They did similar to us - well, they breached my husbands ex's Data Protection and I contacted her immediately to let her know.

EDIT: Not to mention shoes or anything, just to let her know her info was being breached by them.

I am aghast at this-what a mess! She sounds like a very mature young lady ha ha. Hope you get massive compensation for this-then you can be just as mature back and wave it in her face!
Tomorrow is always fresh, with no mistakes in it!
