Hi all,
Could I ask for a little help please.
Am I right in thinking, that if you get a letter from a collection agency, in this case it is LCS Civil Enforcement, that they have to prove this debt to me when requested?
I received a letter posted on saturday saying that I owe £323.87p (not a lot I know), I called them and left a voicemail, and they called me back today.
They said it is for a unpaid moble phone bill 2 years ago, and to be honest this could be the case, because I was terrible with money back then. But, I asked them over the phone for proof of this debt, because as I spoke to the lady I asked her why I should just pay this amount without any confirmation that this is the amount I am supposed to owe.
I know there is some sort of template letter on this site somewhere, but I have searched and can't find it.
Could someone confirm if I am right or wrong please?? and if I am going the right way about it???

I just saw you hadn't had any responses yet so I thought I would pop in and say hi and mention that https://www.nationaldebtline.co.uk have some letter templates that you can use.
I am not sure whether mobile phones are Consumer Credit Act debts but if they are you can request a copy of your agreement regulated by the CCA (the letter is on the site)
All that said, until they prove that you owe this money you don't have to pay. I think there are letters for that too.
When you send a letter don't sign it and if you request a coppy of your CCA agreement then you should send a £1 postal order (not a cheque or anything that you have to sign)

Would I just send the CCA Letter?? the one were I send £1 and request proof of the debt?
Would this be the right one? and do you pay it via a postage note made payable to the debt agency?0 -
Postal orders don't need to be paid to anybody - just ask the post office for £1.00 PO and they can do it without a payable name on it. Do send the letter recorded delivery and check when they receive it.Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free

I read that as well....
But, does this mean that they don't have to prove how I owe the money?? Because surely, if they don't, they can just send out letters to anyone who has had a phone contract a few years ago.
On the phone, the lady said that all they needed to go to court was my name, basic details, and the fact I had a debt - but that they didn't have to show me any proof??????
I find it very strange - seeing as i told them I would happily pay if someone could show me WHY I owe over £300.0
