what information is required to issue CCJ's?

Options
hello everyone.

at university my mate has got herself in to a sticky situation and wants to know whether she has a CCJ or not. she did not pay her rent and received a summons from the court. she ignored the summons because it did not have her parent's/her home address on it, it only mentioned that she currently lived in this rented student house.

nearly a year later and she's heard nothing. is this the end of the issue? or will the court have given her a CCJ without her knowing? i have told her to check the free credit reports that are mentioned on this site.

if she doesnt have a CCJ could this be because the landlord doesnt know her home address? she thinks that the court can get her home address if they want to anyway, but i was thinking if she has a popular name eg. Laura Smith, there are going to be loads of Laura Smiths living in this country so how do the court know which laura smith lived at that student house and didnt pay her rent? the landlord hasnt got a copy of her I.D.

do you think she has reason to be worried about a CCJ? can the landlord hire bayliffs to take her posessions (if he finds her home address)?

    Hi

Wouldn't she have given the landlord some sort of references when she took up the rental agreement? - surely these would have included her home (parents) address details.

She can check the ccj by getting a copy of her file from the credit reference agencies though and that would let her know if this is something that has been recorded against her name.

to cut a long story short, she did give the agency a guarantor with her parent's address on and she gave them her I.D but the agency went bust and everything went missing apart from the contract. so all correspondance from new agency was delivered to her rented student house, which she now no longer lives in.

does anyone know how a CCJ can be issued?

The CCJ would almostly certainly have been awarded automatically as she didn't defend it.. simple as that.

Whether it's linked to her credit file is another matter... she should just check and see.

she hasn't got the summons because she left it in the house. she has the case number though. only thing is we can't work out which website to search for the case on. will it be the county court website for her area? eg. nottingham county court. or is there one main website to search? this is more difficult to find than i ever thought it would be :-s

we've tried www.hmcourts-service.gov.uk amoungst others but no luck.

The case number will identify the court that the claim was issued in - you can then contact that court to find out if it has since been transferred on. What are the 2 letters in the case number? x x
