Help with a CCJ for debt that isn't mine. Unsure what to do.

Hi. I'll keep the details as simple as I can.
I use the equifax credit report monitoring service to keep an eye on my file for changes (to protect against identity theft). I got an alert out of the blue that a CCJ had been registered against my name. I had no idea anyone was trying to get money from me before this point in time.

Having investigated further (calling the court/solicitors/recovery agency/shop), I have established it is Littlewoods Catalogue trying to recover debt on an unpaid account registered at a property I lived at 2-3 years ago. They then sold the debt to a company called Phoenix recoveries, and they hired a solicitor who are acting on their behalf.
I am certain the debt is not mine.
Though I had a littlewoods account, I only used it once or twice for small cost items, and always paid upfront online with a credit/debit card. I didn't have a 'credit' account with them.

Anyway, through fraud or error (I'm not concerned which yet), they obviously think I owe them money.
I'd like to have the court put the CCJ on hold whilst I investigate this. I'm waiting to hear back from the solicitors so they can provide me with a break down of the purchases/dates etc. I'm hoping I can prove it wasn't me with this, since I wasn't at the property for long.

In order to do this, the court want to charge me £75.

Is there anything I can do to protect myself and my credit report here, without paying out? I seem to have 2 choices at the moment:
- Pay a debt which isn't mine (~£200.00)
- Pay the court to hold off whilst I wait to find out what I am exactly being accused of (£75.00).

Advice needed please. The judgement was made in my absence about 12 days ago. I have about 2 weeks to ask the court to set it aside (or pay the money off), or it will stay on my credit record for 6 years (even if it is eventually settled, or prooved fraudulent).

Do I have any other options?

p.s. The only action I have taken so far is to write to the solicitors in question requesting details of the debt, a breakdown of the purchases (and dates, delivery addresses etc). I sent the same letter to the recovery agency directly, and Littlewoods (though they have previously stated on the phone, they will not deal with me at all since they have sold the debt and it is no longer their concern).
p.p.s.) My credit record is 100% perfect in every other respect. This has come at very bad timing as I am expecting my record to be checked in a month or so (for a reason I wont go in to), and I'd like it to be clean.

  • I don't haveany advice about the CCJ but I am aware that they have to prove the debt. Ask they for a signed copy of an agrement you have with them regarding the debt. Catalogue companies never seem to get a signature. No signature = no debt.

    Unfortunately though as its now with the court I don't think that will work :(

    I have checked through my old credit card statements, lx statements etc.
    I am 100% certain it is a mistake.
    I just don't know how I go about defending myself and getting this off my credit report without paying ridiculous court fees.
    What happened to innocent until proven guilty?

    I'd have thought if I could prove to the court that I had no clue about the original summons, they would hold another hearing or something. It is utterly ridiculous... really need help. :(:confused:
