I've been paying Capital One by electronic transfer for over a year now at their preference to repay my debt by agreed arrangement. For some reason one payment never got through. It never got deducted from my bank account so never made it to Capital One. Don't know why.
First I hear of it is almost a month later when Capital One send me a letter about me missing a payment. I check back through my on line statement and sure enough no payment having gone out. So I make another straight away, which is what they asked for so the arrangement could continue.
Then I recieve a Default notice after almost a month saying I am in arrears and should settle the debt. I sent a letter back stating I was unaware of the original payment not getting to them but having paid a replacement. Then about 4 days later I recieve a letter stating that unless I repay the debt or contact them to settle the debt they will issue a Default notice. As I had missed the payment and not paid it since thay could no longer allow me on their repayment programme. This warning of the default notice being issued was written before the default notice but obviously never sent in time.
Today I recieve a letter answering my letter about my replacement payment being made and as a Default notice has been issued, they can not continue with the programme.

I'm having exactly the same issue with Capital One at the moment!!!!!!!!!!!!!!!
My account is/was on a 12 month reduced payment arrangement and I'm about 7 or 8 months in. Last week I received a Default Notice from them!!
When I telephoned them they said it was because of a late payment!! When I questioned them it turns out my second or third payment did not reach them on time!!
I asked to discuss the situation but was told "nothing could be done because the default notice had been issued" and that "I must now wait to be contacted by a Debt Collection Agency"!!!!!!!!!!!!!
I thought all this seemed a bit underhand and when I read your post it all sounded so familiar.
I guess it's now a case of Watch this Space and see what DCA comes calling and if they will accept a repayment plan?
My Cap One debt is for £2800 and I was paying £40 per month - how about you?

Just make an arangement with the DCA you might even get a better deal.Barclaycard 3800

You could request a copy of your CCA and notice of assignment . If yhey do not produce one , then you will be in control !0

Very interesting about a system fault where payments are not getting through.
I knew I'd paid it as I mark it down everytime I make payments on each of my debts.
I've written back to them asking for their complaints procedure. If I'm contacted by a DCA, I'll just tell them the account is in dispute with Capital One.
Does anyone else have the problem that when Capital One write a letter it doesn't get posted for a day or so after and then by 2nd class post. Meaning if they give you 7 days to respond from the date of the letter you have about 3 days left. How come they have 2 weeks to respond to our letters.0
