I've had a 118118 credit card for a while and this week I've received both an email and SMS offering me a pre-approved loan for £5000 although with a high 35.90% APR. Are they classed as a payday lender and do they record as such on credit files?

Car Loan from Parent
My wife and I have kindly been offered a loan from her mother to avoid car finance. We have agreed a payment schedule but wondered if there were any tax implications as a result. The amount is more than the £3k gift allowance but as its a loan is this relevant? Thanks.
