Estate tax return query
My mum passed away in December, (left me as the sole executor) as a result I used the same solicitors who already held her will and property documentation for ease, plus, I was too distraught to actually think straight on my first visit (to engage the Solicitor). They offered to use their preferred Tax Account to sort out…

Share of married partner's assets in estate
Hi If my wife and I own a house jointly, and she also has a property in her name, if I die, is half the value of 'her' property included in my estate? Equally, if we divorced (children are adults) would I be entitled to half the value of the property in her name? TIA Vigman

Joint tenants - separate wills?
Hi, My mum, who's in her 70s, just made a will with a local solicitor. She has joint ownership of the house with my father and wanted to leave her share to me and not my father (they have a terrible relationship). She was told by them that by law they needed to contact him. They sent him a form which he said he is not…

Signing off estate accounts
Firstly, am I correct in thinking that signing off the Estate Accounts when a solicitor has been used as an Executor releases them from any further liability for further taxes? Secondly, why would a solicitor refuse to let a beneficiary see the draft estate accounts towards the end of the Administration? TIA

Help With Trustee(s)
I've posted this elsewhere, yet was advised this is a good place to post the query I have. Complaints were brought forward to the two trustees of my late mother's estate. The funds were left languishing in their account for 2 years. They didn't invest the funds nor seek independent financial advice as they were supposed to…

Insolvent Estate
I was the executor of an insolvent estate, and so advised not to do anything, which is fine. I am aware that creditors can apply to administer the estate, but what happens if nobody does? Does it just sit in limbo for the rest of time?

Question about Trustee and LPA--So many issues!
Complaints were brought forward to the two trustees of my late mother's estate. The funds were left languishing in their account for 2 years. They didn't invest the funds nor seek independent financial advice as they were supposed to do. Instead they put the money into a regular account and were only to tap into the…

Council Tax Exemption during Probate
My father died in December and I've recently received a Council Tax bill for the full amount for 16/17 plus repayment of his single occupant allowance for the period between his death and the end of FY 15/16. I understood that this should be exempt under Class F1 while I await probate (and subsequently for 6 months after…

The Trustee Act 1925
Can anyone tell me if this notice only has to go into the paper if there is a property and land left? on reading through it keeps referring to land/property. Reclaiming tax on savings interest after death
At the time my dad died he had some cash ISAs. In his will he left specified amounts of money as small legacies to myself and my children (his grandchildren) with everything else going to my mum. The tax free status of the ISAs stopped at the date of death, so when the money was eventually paid to my mum (after going…
