Is probate essential?
My wife is executor for her late aunt's estate. There is no property involved, estate comprises a bank account at Lloyds - below their probate threshold, an ISA account at Nationwide - under £15000, so probate not required by them if an oath is sworn at a solicitor and a very small insurance policy. The funeral has been…

benefits / inheritance question.
I am currently claiming housing benefit, but am due to inherit in the next few weeks. This means I will no longer qualify for housing benefit. I am unsure as from what point I will have to cancel my claim for housing benefit. Is it from when the property being sold is sold or from when the assets are divided up? Thanks in…

Delaying Probate?
I am acting as executor on an estate awaiting sale of property since Jan 2013. I was advised by Council Tax office to delay application for Probate until we have a buyer for the property as otherwise CTax is payable after receipt of Probate. Are there any pitfalls of doing this? I have taken their advice & not applied yet.

London Gazette
Hi I've tried to google for the answer but it's not really confirmed things so thought I'd ask here. Do you have to put a notice in the London Gazette for every deceased persons estate? Or is it if they are leaving monies over a certain threshold? Or if it is likely they have debtors? If they die intestate but with…

IHT - Transferrable nil-rate allowance before 1975
A friend's father has just died. He was a widdower, and his wife died in 1968. When she died, she had no assets of any substance, left no will, and everything passed to her husband. I'm trying to understand what proportion of the late wife's IHT nil-rate band may now be transferrable to the husbands estate. The husband's…

Mirror Wills - Do you HAVE to extract Probate ?
Dad died in 2004. Grant of probate was never extracted for his estate. Although he & mum both had/have mirror wills (which have not been superseded), which were written before he died - we were told Probate wasn’t always required - this typically arises when the value of the deceased persons assets is very small or when…

Charities chasing legacies
Mom died in February 2013 and I was granted probate of her will at the end of April. Amongst other bequests, she left bequests to 6 charities. These were paid in July. Last Saturday, I was surprised and annoyed to receive a letter from one of the charities, basically wanting to know where their bequest was. The sum…

Change Executor of an estate
My Father has named a local solicitor to be the executor of his will. I would like to take on this responsibility when my Father dies. Is it correct that my Father could write a letter to his solicitor informing them that he no longer wishes them to act as executors? Also if my Father dies without changing the executors I…
