How do I sue a Bailiff Company?

Right after months of research etc and a full admission from themselves that they mucked up I would like to sue them for compensation.

They have contravened the CCA1974, the Companies Act 1989, Fraud Act 2006, possibility of debt collection without a full licence.

Who how and where?

Thank you so much and any points of law I may have forgotten please could you point them out.

    What about asking for some form of sponsorship? I would immagine that this would be a test case, so someone should want to help.

    If I were you, I would book 2 or 3 free 30 min appointments and see what they say, then if you were a test case I would try and get in contact with Martin or someone similar to him, to ask if they could help in any way possible.

    I think he said there was some sort of fund for people wanting to take the banks to court to reclaim charges. So maybe he may want to help if it was in the publics interest?

  • SH - wow that is brill advice - will do - someone I know has already got a solicitor looking at his case and mentioning mine so when they get back to him with the points of law I will suggest it

    not a legal expert but i would think that

    a. if you have suffered financial loss then you can sue in the small claims court

    b. if they have broken the law etc. then I dont see you could actually sue them as such but would need to make a complaint to trading standards, OFT, Financial ombudsman

    Bailiffs are usually registered with one of two trade bodies.Find out which one.

    An improper levy - a car that did not exist - CCA 1974 Section 25(2) (?)

    Multiple phantom visits - Fraud Act 2006

    Incorrect registered address on letterhead Companies Act 1985

    Paying a percentage charge on debit card transaction CCA1974 (25)(d)

    I am still awaiting the return of the charges that I have paid
