POPLA Appeal Rejected - Seeking Advice
Minezey
Afternoon All,
So I'll give you a quick rundown of what's occurred in bullet point form for ease of perusal:
- Parked my car at my local train station
- Called up & paid via RingGo using my debit card, confirmed reg no. etc
- Returned to my car to find ticket on my windscreen
- Checked with my bank and payment had been taken
- Upon appeal MET said that their automated service had heard and stored a 'B' instead of a 'V' in my reg number.
- I sent proof of payment along with phone records to show the call made to RingGo.
- Appeal made to POPLA, gave feedback that automated system may want to use phonetics when confirming the reg number to alleviate errors.
- POPLA rejected my appeal citing ''Having reviewed the case there was no valid session in place for V## ### when the charge notice was issued therefore we believe that the charge notice was issued correctly and the appeal should be refused''
I was surprised that an independent body set up to protect consumers has sided with the PCN company (MET)
Not sure of what I should do next. I've paid for the parking so surely they can't claim for lost revenue.
Any advice?

you have paid for parking, you can prove it !
I would ignore their demands if I was in your shoes.
POPLA decisions are not binding on you at all.
If the PPC were stupid enough to take this to court you have a cast iron defence don't you?0 -
Wait until they take you to court.Afternoon All,

Then once you get the court papers respond denying the claim.:footie:
Regular savers earn 6% interest (HSBC, First Direct, M&S)
Loans cost 2.9% per year (Nationwide) = FREE money.

Ah yes, the wonders of the totally independent body know as PoPLA, paid for by BPA, who are paid for by the PPCs, who sole aim is to fleece the poor motorist of every last penny.
You have fallen into the trap of thinking that sensible mitigation would result in a sensible outcome.
Welcome to the world of the PPC scam.
If you had checked here first then we would of told you how to win at PoPLA.
Now, your choice is to ignore the next stage of the threatograms and wait to see if you get a letter before action from the PPC.
I don't think MET have a reputation of carrying their threats through to Court and I doubt with your evidence that they would do so. Enough mugs pay up anyway.
Just for the record, you didn't get a ticket. Only the Police and Council appointed Wardens can legally issue them. You have received a request for monies for alleged breach of contract, of which the economic loss to anyone is erm... zero. They disguise there speculative invoices to look like parking tickets and current legislation allows them to.Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.0 -
Well this is pathetic isn't it ? The BPA has said on twitter that they expect parking companies to use a common sense approach to situations of the wrong reg number being given, especially when it's just one letter or number out !
Obviously MET has no common sense, why doesn't that surprise me ? Ignore them they have to date never been to court! I can prove it

Thanks for the advice guys/girls!
I suppose you always questions whether you're being unreasonably stubborn in these cases but the fact of the matter is that I paid for my parking session so they can 'go swivel' if they think I'm going to pay another £1000 -
Shame MET are not known for doing court. They would be a complete laughing stock if they tried it on with this one. Easy to prove their loss is zero, there is no case.0

POPLA is a kangaroo court that is run by parking companies for parking companies, uses falsified evidence and trains parking companies how to beat motorists.
They are getting dragged to heal like little dogs by the parking scammers.
Soon there will be no "wins" at POPLA and it will be back to square one.
On this firm, I would write and advise them to take you to a real court, not one with kanagroos on the panel.Be happy...;)0 -

I'd play the game, ignore now and then only act in the unlikely event of receiving The LBA, which will never come. They will eventually go away.Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.0 -

That list of court cases since last October includes:-
MET PARKING SERVICES LTD 51 LLOYD BAKER STREET with 2 cases which does pale into insignificance compared to CEL (1101), UKCPS (515) & Parking Eye (2378). So PE comprise almost 50% of the 4806 total.0 -
I missed that one Nigel I admit, but it does put into context nonetheless, 2 claims in 8 months, it says it all really. And being generous they probably won one of them as it is 50/50 going there. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you.
