Court Order for Sale - Ex wont sell

I hope someone can help. Like many subjects i have read, i am in the common situation of after 3 years sharing a house with my partner, we have seperated however still living in the house, trying to sell. I have offered a buy out figure and this has been declined (for no good reason other than, why should he let me have the house') The problem is, the house is on the market, has been for some time at a high price. He wont sell for a penny lower despite advice from estate agents. I am at my wits end and am desperat to move on. Can i get a court order for sale and at what price will they order we sell at? i dont want to loose any equity... Please help!

  • A court order will force a sale. Whatever it sells at is down to whatever someone else is prepared to pay for it. Court are not RICS surveyors.

    Have you offered to sell your share in the property to the ex?

    Although I wasn't having to live under the same roof with my ex, for many many months he insisted on keeping our house on the market at a massively high price. I just had to chip away and try to peruade him reducing the price was the only way to go. I eventually succeeded and we found a buyer. Good luck.

    does your ex still pay towards the house you used to share ?
    ahh just think i have re read and you are both still living their so i expect your both still paying sorry

  • The sad thing is that you will find that you will be caused a great deal of stress and expense and there is no easy solution.

    I expect now you regret entering into the relationship. It is sadly only hindsight for you, but if some couples considering buying together realised the level of trust and commitment they to have in each other to make it really work they might decide better of it. I just wish that those buying would look at forums like this and see the pitfalls before they buy.

    In reality the commitment isn't far short of marriage and if you are not prepared to commit to that, then it may be worth considering whether you really want to tie yourselves to each other financially in this way.
