Onthebeach.co.uk Refund

I wonder if some kind soul can advise me on my rights.
We booked a holiday through onthebeach.co.uk a couple of weeks ago. The holiday comprised of JMC flights, flight extras, transfers and hotel. We paid for the holiday on our Credit Card and paid the Onthebeach credit card surcharge.
On Sunday our flight was cancelled by JMC who said that we would get a full refund.
Onthebeach were impossible to contact on the phone and we received an email from the a few days later saying that we could get a refund for our flight and cancellation charges would apply to everything else. We were not given any options and advised what the costs would be.
Onthebeach have emailed today and said that we are able to get a refund less £30 per person (two adults and two children) and they would not refund my credit card surcharge even though they would be refunding me ninety percent of what we paid to the credit card.
Are they acting legally? I can find nothing about credit card surcharges in any communication that they have had with me nor on their website. The cancellation fees are their own and not that of the hotel.
Should I contact my credit card company for a chargeback?
Can anyone advise?

I booked my hol with onthebeach.com and pestered them for a whole wk trying to sort things out after it was cancelled due to the volcanic ash cloud... Very frustrating trying to get any answers from them however, i managed to rearrange my holiday for the following wk and have just come back..so you would probably be better off trying to do that and rearrange to another date - at least that way you do not lose any money...They didnt charge me anything extra and the hol was fab!0 -
Have you googled Onthebeach to see they have poor customer service?
I think they are acting within their T and C as you wont have booked a package, ie all parts of your hol are individual thats how they get away with it.
Only a package would get you a full refund thats my opinion.
You could always do waht Kitty did and move your hol to another date0
