Rental contract help

Huge dilemma, any advice is greatly received. We signed a contract to move in on x date. The landlord came back 1.5 weeks before x date to say can't let us move in as her current friends/ tenants need another day. So move in day is now x+1. No negotiation with us just told us.
Not even confirmed to say whether we will be given keys on the morning on x+1. LL is supposed to provide floor boards which my DP will install in the two rooms where there is carpets as I have allergy. They cannot confirm this will be provided on the x+1 date.

Flat was advertised furnished or unfurnished. As we have funiture we only looked at unfurnished. The contract says flat, fixtures and fittings rent is £££. Agent now says we didn't say we wanted unfurnished.

Is the contract void now? We don't have space and can't afford to house the extra furniture! We have paid deposit. Can we claim back and walk away from this now?

    The contract has been breached by the landlord. You do not need to accept the new conditions.


    You can just walk away. (and sue for any out of pocket expenses - e.g. agency fees)

    That business with the flooring (carpets/ boards) was in my opinion asking for trouble from the start. If the property doesn't suit you don't apply to rent it. Some flats have conditions in the leases that the floors have to have carpets on them to reduce the transfer of noise to other flats. If this is the case in this one the landlord can't allow someone to put down boards.

    Also you have to understand that a landlord does not want the property to be vacant so if you could move in on the day that you were originally told if that was also the day the current tenant moves out when do you expect the landlord to lay the floorboards?

    I'd try to get the LL to confirm in writing that you cannot move in as per the contract and instead how much later it will be before you have keys + floorboards. Otherwise if the LL does get it together in time and you make other arrangements / choose not to move in, it will be hard to prove the LL breached.
