Non Fault Car Accident - Damage over 5k

Hi,
Someone rear-ended me a few weeks ago.
My Audi Convertible is 8yrs old and cost me 9k just four months ago.

The insurance have said they are going to repair it even though the damage is over 5k, with 5yrs guarantee.

Erm....what about if I come to sell my car, surely the value will be considerably less than one that hasn't been in an accident.

The insurance said it wouldn't be listed as Cat C and it's not up to me if they choose to repair as I said I didn't want an accident repair car.
It took me long enough to find one with low mileage, fsh and one owner as it was.

Anyone know where I stand with this? Is it possible to ask for a diminutive payment even??

    The insurance company has every right to repair the car if that is what they choose to do. It won't be listed as a right off as they are not righting it off. As far as another payment because it has been accident damaged, I doubt it.

    Why will the value be considerably less? Your car may have been repaired previously and not disclosed.

    I don't see how a professionally carried out repair would decrease the value of the car?

    Your car is 8 years old I doubt this would be the first repair it has had and I doubt you would find a car of that kind of age which hasn't had any repairs. I know that this is a major repair but it really is no different to any other kind of repair as long as it is carried out correctly.

    You may have a claim, but it'll be difficult to claim.

    There is a head of claim called Diminution in value, however due to the age of your vehicle and it not being a specialist vehicle, diminution is unlikely to apply. Usual criteria for something mainstream, the vehicle has to be less than 3 years old. It is generally only bona fide classics or exotica which escape that rule/ principle.

    I would not bother and would just make sure the repairs are done to a high standard.
