Injury Claim - Take First Offer?

I'm looking for a little bit of advice.
I'm currently involved in a compensation claim against my former employer in relation to an accident and injury in the workplace. They have accepted liability, and based on a medical report on my physical injuries they have offered to settle for the sum of £6000. However, before this offer was made my solicitor had referred me for a further examination for psychological after effects as I developed severe anxiety and depression as a result of the accident (but I have had a period of depression prior to the accident) .
So my question is, should I accept the offer, or hold out for the mental health assessment? Would a previous instance of depression be used against me?

You need a frank discussion with your solicitor. If they are saying it’s a good offer then take it. If they don’t think it’s a good offer they will say don’t take it. When I was in a similar situation they said the first offer is £4000 however if we went to court the expected payout is £6000. So it was an easy choice to reject. Second offer was £5700 and they said accept as going to court would drag on and there is always a risk you may get less. These solicitors deal with hundreds of cases at a time and you are just a number. Ring at 9am when they are not busy yet and ask outright what they think.0

No reject it, your claim is worth Gabillions!
Seriously though, even though I deal with personal injury claims for a living, I haven't a snowball in hell's chance of advising you what your claim is worth without access to all of the medical evidence. So as Quentin has said, the only person who can give genuine and helpful advice here is your solicitor.
Complain and ask for someone else to get back to you if they are not going to offer you proper advice.
They do act on your instructions and can't tell you to accept an offer, they can only offer advice and you then make a decision based on the advice and issue the instructions to the solicitor.0 -

Taking everything into account I have decided to take the offer. The injuries I received didn't have a lasting effect, and some mental health problems I suffered as a result are very likely to be overlooked because of previous depression apparently. All things considered, I think a future offer or final settlement would be lower. Hopefully the case will have resulted in them dealing with the problem which caused the accident, but I'll never know because I no longer work there.We have removed your signature - please contact the forum team if you are not sure why - Forum Team0
