    Kay Brandeaux. Covert Emails 'Could have collapsed Company' Brandeaux Advisers UK & Ors V Chadwick. The High Court London Queens Bench case presided over by Justice Jack and reported in the Irish Independent. 'A former Dublin - based senior compliance officer who covertly transfered a vast number of confidential company documents could have precipitated the COLLAPSE of a UK property investment firm that manages £1.7bn (euro 2bn) of assets, a London Court has heard. January 5th 2011.

    Brandeaux Thurloe Properties Ltd Kay Brandeaux Thurloe Properties Ltd (British Virgin Islands) Stephensons Solicitors High Court. Design Progression Ltd v Thurloe Properties Ltd 2004 EWHC 324(CH) 25th February 2004. Judgement Mr Justice Peter Smith at para 34 states, "First there was Kay Brandeaux who apparently occupied part of the premises occupied by Chancery St James Plc who employed Mr de Lerios, apparently the defendants managing agent who was not called although it is quite clear that she had apparently the most significant role in the decision making process. There was no suggestion she was not available and no reason given why she was not called. Absent any explanation for her non attendance. I am bound to conclude that the reason she did not give evidence was because her evidence would not be favourable to the defendant and would reveal matters to its disadvantage. Justice Peter Smith..."Little is known of the Defendant. It chose to adduce no evidence in relation to what decisions it actually made. It is a company registered in the British Virgin Islands and apparently operates by Power of Attorney granded by Robert Keith Corkhill an Attorney in the Isle of Man. It's Company Secretary is a Limited Company ColoTrust Secretaries Ltd (Jersey) and it's interests and Officers remain shrouded in mystery. Jutice Peter Smith High Court. Stephensons Solicitors are registered at the Land Registry as representatives of Shenton Properties Limited (Jersey) sole shareholder a BVI registered Company. They own Shenton Hall Shenton near Nuneaton where Miss Brandeaux declares herself as a Rental Tenant in this listed Jacobean Mansion set in it's own parkland. Miss Brandeaux is of course Liberty Living PLC providing student accommodation in the UK which is the driving force behind the Brandeaux Student Funds based in the BVI and listed on the Irish Stock Exchange which even in this current financial downturn continues to return investers high yields from a property based investment fund. Brandeaux Advisers & Ors V Chadwick Justice Jack also makes interesting reading as to the inner workings of the Brandeaux web of Companies.

    I can't believe it's been a couple years, and the Friends Provident site says there are still redemption problems with these funds. On top of this, I've met with people who have been advised to buy this fund since the collapse, without being told there have been any problems with the fund. This is a straight up Ponzi scheme - getting new people in to let the old people out. I can't believe it's been going on for years without anyone shutting them down yet (on top of how egregious it is for IFAs to direct new clients to this fund without mentioning the problems).

    Have the posters that said they have their life savings in this fund been able to get any of their money back yet?

    I wonder what has happened to the price of shares/units in this fund since 2008?

    Glanmore Property Fund was another fund which had and still has redemption problems (think Glanmore investors were looking at 3 to 4 years delay in redemptions). Their price has dipped something like 75% to 80% from the highs.

    Even as an Expat I could never put money into offshore investment funds like this, e-mails arriving every week promising fantastic dividends and growth

    Sell orders come in...
    -First meet redemptions with cash on hand
    -Then if redemption requests are multiple times higher than what you can borrow or find cash for - the fund should start looking to sell assets to meet that demand. Unless the fund is carrying a defined lockup period, that's how investing works.

    At the minimum - all new investors for these funds should be made well aware that this fund has recently had major liquidity issues, and that investors still have to wait for months to get money out.

    Chancery St James Plc acting for a client and working with Allsop the Estate Agents recently sold Parkwood apartments 22 St Edmunds Terrace, St Johns Wood London NW8 7QQ to a private investor for £34 million. Chancery St James Plc is the 'appointed' Property Asset Manager for Brandeaux! The grand plans to demolish Parkwood an 18 year old building to build a glass fronted edifice submitted by Parkwood Properties Limited were refused by Westminster Planners on 12th February 2009. The sale was completed in July of this year. Chancery St James Plc operates from Level 32, 30 St Mary Axe (Gherkin) in the City where several wholly-owned stand alone Brandeaux investment subsidiaries of GR Property Investments Limited are based. GR Property Investments Limited (BVI) and its subsidiaries is ultimately owned as follows: Ground Rent Income Fund Limited. (IOM) The Ground Rent Portfolio Limited (IOM) and Ground Rent Portfolio Plus Limited (BVI). Miss Kay Brandeaux wholly owns and operates the named companies from her HQ in the Gherkin with her boyfriend and partner Mr Roger Boyland. Chime Properties Limited (UK) have a listing (23rd April 2010) of Loan Notes on the Irish Stock exchange GEM. The Company Secretary, Manager,Property Asset Manager, Investment Adviser, Administrator are all Kay Brandeaux companies so it is no wonder Mr Boyland (Director) chose to give an address C/O Westminster Services SA, 7th Floor, 65 Rue du Rhone, Geneva, 1204 Switzerland, this is also the Swiss Office address for Miss Kay Brandeaux. They both live in a £26 million villa in nearby Cologny. Miss Brandeaux is not an officer of Chime Properties Limited (UK) a private listed company based at her HQ but Mrs Joy Rose of Henderson Nevada is both a Director of Chime and GR Property Investments Limited (BVI) the Parent Company of the group based and operated with a rod of iron by Miss Brandeaux from her Gherkin London HQ. Miss Brandeaux of the landmark unscupulous Landlord case involving Thurloe Properties Limited (BVI) and Chancery St James Plc was in the High Court recently in the case of Brandeaux Advisers & 0ther Brandeaux companies v Chadwick, paragraph 34 of the judgement makes interesting reading as to Miss Brandeaux's Management style. Miss Ruth Chadwick was a Director of Chime Properties Limited in 2008. The listing of Loan Notes in Ireland and the sale of a £34 million London Property should provide income!!

    Kay Brandeaux in an update following the re-opening of the funds on 30 April 2010 states at paragraph 4, " The funds invest in GR Property Investments Limited (GRPIL), the pooled property holding company, which own all the ground rent and reversionary properties in which Brandeaux funds have an interest. GRPIL made a consolidated revenue profit of £10.6 million for the year 31 March 2010 (2009 £9.6 million) in addition to £40.0 million (2009 £22.6 million) uplift in capital value of the property portfolio.. The Funds are, Ground Rent Income Fund Limited, The Ground Rent Portfolio Limited, Ground Rent Portfolio Plus Limited.

    The Chime Properties Limited Loan Note listing on the Irish Stock Market GEM available on google states at 'Notes To The Financial Statements for the period 1 August to 31 March 2009;-

    Section 12 Controlling Parties, The Company's immediate parent is GR Property Investments Limited (GRPIL) a company incorporated in and registered as a BVI Business Company in, the British Virgin Islands. The GROUP comprises GRPIL and its Subsidiaries and is ULTIMATELY OWNED as follows:
    Ground Rent Income Fund Limited, The Ground Rent Portfolio Limited, Ground Rent Portfolio Plus Limited.

    The Ultimate owners of GR Property Investments Limited invest in GR Property Investments Limited according to the Kay Brandeaux update (available on Google but maybe not for much longer) which also values GRPIL's holdings at £718 million as of 31 march 2010!!

    Why did Kay B choose to pay redemptions, could she not have allowed
    brokers, like Skandia, to resell their clients " shares" quietly ?

    Appreciate some update contribution on this fund, at this moment, did those investor able to cash out their money at the end.

    how safe is this fund now?
    by reading all of these back ground on what's happening, it seems to me it is not safe, but the fund still surviving and having more investors.
