CEL pcn issued when pay and display - advice please - oh written to them

My oh received a pcn from cel for parking and not making payment. Unfortunately he's a little bit tempestuous and he wrote straight back to them stating he had paid and supplied a copy of his bank statement showing payment rather than checking these forums :(

They have now written back requesting his phone number and a copy of the phone log.

Any advice on how to proceed here please? Should he write back stating he has already provided proof of payment and that they should cancel the ticket? I've searched through the forums but the closest example I could find hadn't already entered into correspondence.

Other point to note is he leases his car and isn't the registered keeper.

    Write back and say for obvious reasons he declines to give his phone number to a notorious PPC who are known for suing Co-op customers and have a terrible reputation recently. So he has nothing to add to his appeal, can see that they have made no loss and issue unenforceable penalties (CEL v McCafferty was lost at appeal this year) and as such he will cheerfully move on to POPLA stage if they do not cancel now. Remind them that they have only two choices, POPLA code or cancel the PCN.

    But make sure he doesn't write the POPLA appeal. YOU WRITE IT IN HIS NAME, USING OUR TEMPLATE ADVICE!

    Contact them via email or letter,, don't call them as this lot lie through their teeth like all parking companies. And inform the below as well by the dvla. Ensure that you don't do the popla stage alone, they don't do mitigation and only really accept legal arguments.

    • Asking the motorist to enter into additional correspondence to obtain a POPLA code
    • Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
    • Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
    • Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied “
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    His phone number surely is not a problem, but why should they want to know whom he has called. Ask them why they need it, build up a paper trail, and, if they are acting maliciously, sue the pants of them.
    You never know how far you can go until you go too far.

    Or alternatively, do what respected posters Coupn-Mad and Storma have suggested. Send one more letter/email, get your POPLA code, get this sorted, get out job done.

    Thanks for the advice. Letter written requesting cancellation of ticket or popla per templates - will advise result.

    A successful update on this. Letter sent per above. Just received a letter back today cancelling the ticket. No need for popla etc. so result :) as an aside - after I posted this I too received a PCM from cel for overstatyng in a retail park. I sent them the keeper letter per newbies forum and that too received a straight cancellation reply. So big thanks to coupon-mad and others for their advice - and to anyone else reading this -- follow the advice in the newbies thread!! It works :)
