can a business seller legitimately say this

"In the event an item is not delivered or has gone missing, you are responsable for making a claim with Royal Mail. .......,, I will provide you with proof of posting and support you where possible"

Or if an item did go missing would they have to refund regardless of the spiel? It's an item that's a bit cheaper than usual, but the lack of spell check is off-putting (probably my pedantry) with the dodgy t&c's. They are showing as a top rated seller with 100% feedback, although they've only sold 300 items in total.
DSR of 4.9's for item as described and 5 for dispatch/p&p.

Edit - just found this reply in their feedback -"Item was lost by Royal Mail, Buyer did not want to claim and forced us to refund."

So they'd probably be a pain if it did go awol in the post.

    They will soon learn when more buyers use the INR system and reclaim payments.
    I would still buy from them if the price was right and other sellers were significanrtly more expensive.

    To answer OP directly, a business seller cannot legitimately enforce the terms you describe - eBay will do the enforcing.

    "In the event an item is not delivered or has gone missing" make a claim and get your Paypal refund - it is for the seller who despatched the item and has the certificate of postage to make a claim with Royal Mail, Parcelforce etc etc.
