    It's not a fine. Only a court can issue a fine. The HMRC can only issue a penalty.

  • maybe the sensible thing would not be to leave it till the last day and then complain you can't get through to the helpline

    I was told yesterday by HMRC that as long as tax is paid by 31/01, no penalities would be charged for late filing until Feb 15th.

    Only if you've applied - and are waiting for - an Activation Code.
    If you want to test the depth of the water .........don't use both feet !

    Looks like they are confused too.
    If you cannot get your activation code in time to file on line - having asked for it by 31/1/12 then so long as you file on line by 15/2/12 HMRC say they will waive penalty (in other words they will automatically accept you have a reasonable excuse for late filing)
    If you file on 1/2 or 2/2 they are now saying pretty much you will not have penalty either because strike action on 31/1/12 may mean you could not get through for help. You do not have to show you tried to ring - it seems to be a blanket thing.
    You still need to pay any tax by 31/1/12 as I understand it to avoid interest etc. You can always estimate that or at least try and pay some & pay the rest once you have done return.
    And don't forget all the rules on late payment surcharges etc have changed too....

    maybe the sensible thing would ...

    Maybe the sensible thing would be to fire public sector workers who go on strike and time it to cause maximum disruption..

    Perhaps if they don't like their jobs they could become plumbers, builders etc etc

    Taken from HM Revenue etc:

    31 January deadline
    The deadline for online tax returns is midnight on Tuesday 31 January 2012.

    HM Revenue & Customs (HMRC) will not impose any late tax return penalties providing you send your online Self Assessment returns on 1 or 2 February. This is to make sure you aren't at a disadvantage if you can't get through to HMRC call centres on 31 January.

    The Self Assessment deadline is still midnight on 31 January. But HMRC will treat all tax returns received by midnight on 2 February as though they were received by 31 January.

    Customers won't have to pay interest on payments due on 31 January, providing they are paid on 1 or 2 February.

    If your online tax return is received after midnight on 2 February, you'll have to pay a penalty, even if you have no tax to pay or if you pay all the tax you owe on time.

    You're confusing 2 x quite separate issues.

    Your quote referes to a couple of days dispensation as a result of industrial action - on both filing and paying. Murdina was referring to something else entirely and where a new activation code has to be requested ... which allows filing only up to 15th Feb. The dispensation will only come verbally from the Helpline - they're unlikely to put it on the website for fear of others getting confused also! :
    If you're new to online filing.
    If you haven't sent a Self Assessment tax return online before, you must first register to use HMRC Online Services. You needed to do this by 21 January 2012. This earlier date was to make sure you received your Activation Code in time to send your return by 31 January.
    You may not now receive your Activation Code in time, but you should still register for HMRC Online Services if you haven’t already done so. Once you get your Activation Code, you should send your tax return online straight away.
    If you want to test the depth of the water .........don't use both feet !

    Perhaps if they don't like their jobs they could become plumbers, builders etc etc
    Their argument isnt with Joe Public, its with management ! - oh and can you imagine the payouts they would get for unfair dismissal

    ah - sorry. i scan read the first bit about the activation code. the only point (which i didn't make clear at all) that i was trying to help clear up was that you have until feb 2 for payment to reach them without getting charged interest. as i understand it, that applies to all payments so it's not entirely a separate issue.
