I think if there is clear evidence of mis-selling then yes, it's absolutely right that compensation should be paid. I suspect the problem is going to be that it's going to be very hard to prove one way or the other.

I would think the more important thing to do is ban doorstep selling of energy products.

  • What about small businesses as well and telephone / verbal contracts?

My wife was a victim of this where she was promised that the company calling was connected to our existing business energy company and that they could offer cheaper electricity by completing a contract. It was after this that they started recording the conversation as their "Oral Contract" and we found out that we were tied in to a two year contract that was more expensive than our existing supplier or faced with paying £300 to exit the contract.

There appears to be no protection for the small business as there is for the consumer.

I quite agree with you; this is a major area Ofgem need to look at. Ofgem seem to think that businesses are 'fair game' and thus don't need the same level of protection. Whilst this might be true for large companies (100+ employees) there should be a lot more protection for small businesses.

I hope that they do bring something like this in. This industry needs to get rid of the rogue saleman.

An outright ban would be a far better solution. The process serves no good purpose, whatsoever.
