BPA parking charge for parking in morrisons! Help!! :(

Hi everyone, I'm a newbie here so sorry if I have posted a thread that has been posted before.

Firstly, I'm from Scotland (as I have seen there are different rules for parking in Scoland to England and Wales). I parked my car in Morrisons car park in Paisley at 12.45 and left the car park at 4.10. I have been fined £85 or £50 if paid within 14 days.

Firstly, I met my brother (a business owner across from Morissons for a quick chat) then continued to wait around the area of Morrissons to meet a gentleman for a local publishing house to meet to discuss my idea for my book.

This meeting took place in Morrisons cafe (which unfortunately I don't have the bill for as he paid).

After returning to the car I made my phonecalls a to family members discussing the conversation with the gentleman.

I was in the vicinity of Morrisons during this time, at not point did I leave to go galavanting around Paisley town centre. Can they do this to me?

I'm very upset and I don't know if it is even worth while on me appealing if I have to pay nearly double.

The company that fined me is "parking eye". The top of the charge says member of BPA,and displays "approved BPA operation" and Healthcare parking charter.

Please help :(

Lorna

Firstly it's not a BPA "fine" and nor is it a fine !

Being in Scotland you have an advantage over us in England and Wales - you can safely ignore the PCN ! You'll get the usual load of threats via letter but just file them and continue with life. DO NOT respond to them.

Thank you so much for your quick response Hovite. I was on the brink of tears! I really can't afford to pay this "charge" but I don't want to get into trouble for ignoring it either.

What could ultimately happen if I ignore it?

Sorry for being a pest, my Mum and Dad have just went through me like a ton of bricks for being so stupid :(:(:(:(

    Thanks again for your response:A

In theory ( and I really do mean in theory ) they could take the driver to court because the driver has either broken a contract ( so they would be seeking damages ) or the driver hasn't paid what they should have done ( so they are seeking that loss ).

BUT these private companies confuse themselves as they can't ask for both and often they're not sure what they are asking for !

In Scotland ONLY the driver is liable so if they don't know the driver they have nowhere to go. Hence the advice of not responding at all.

You should direct your parents to this page and get them to read up on the con - and it really is a con !

Yes. genuinely ignore as if you write ANYTHING, it could actually backfire. If they have no information to go on, they don't know who the driver is.

In England, they can come back on the owner because of POFA. POFA doesn't apply to Scotland.

Would you suggest phoning Morrisons regarding this? Or is it best to genuinely try to forget about it?

By all means complain to Morrisons ( I always recommend going in hard against the retailers who use these scammers but others will advice being polite ) BUT don't tell them who was driving as they will probably pass that information on.

Something along the lines of "I'm the RK of the car that received PCN ref xxx. I spend £x a year in your store and if you do not cancel the PCN immediately that money will go to Tescos."
  • Go with the above poster. It's good advise. Always good to tackle the store.

I am collecting recent thread links of examples where fake PCN scams have been cancelled by the Supermarket/college/Hospital or retail park management, after a robust COMPLAINT that does not admit liability or fault, but which shows you/family to be regular customers (show any recent receipts) or just says you'll go elsewhere. Phoning is NOT the best approach to any complaint though, it's a very weak attempt and very easy to be fobbed off!! This is a formal complaint so write a letter or go in person, dressed smartly, and demand assertively but politely to see the Store Manager (not a random duty Manager dragged off the meat counter, ONLY the Store Manager):

Always complain about this scam, and teach your Mum & Dad that this is nothing but a well-known con, exposed more than once on Watchdog. Show them this:

That video is still true as far as Scotland is concerned (unlike in England where we have an appeals system of sorts, which we are having success with).

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
