Item never dispatched and refund taking for ever..

Hey guys,

First off I REALLY wish I had googled the company in question before purchasing as I would have never in a million years used them...but hindsight is a wonderful thing.

On the 21/08/2015 I purchased an item and paid in full £230.

On the 28/08/2015 The item was showing as "processing" and an estimated delivery time of 28/08/15 - 04/09/15 was given. I was informed that they needed to receive the item from the manufacturer.

On the 04/08/15 I queried where the item was as it still showed as "processing" and was told it would arrive in a couple of days.

By the 11/09/15 I decided to cut my losses and formally requested a refund. They told me it will take a couple of days for it to be in my account.

I have chased it three times now and have had the same generic response back saying they are sorry and will ask finance. I have informed them that this is the 14th day and their Terms and Conditions state that this is the maximum number of days for the refund as well as consumer rights etc.

Is there anything else I can do? I purchased it on a Debit card through Natwest and I am concerned that a charge back will take forever. I am also miffed that I have basically given this company an interest free loan of £230 for over a month!

Any advice would be great! Sadly I can't bombard their twitter feed or Facebook page as it seems to be locked (surprise surprise)

Is this a UK company you are talking about?

As you have noted, under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 they have 14 days from the date you notified them of the cancellation, to refund your money.

Today is 25 September - exactly 14 days from when you cancelled.
    Hardly taking 'forever' are they?

A chargeback should be pretty quick, certainly not forever, but I guess it's all relative.
Forever, pretty quick, not really definitive times are they? :D

I think I would be considering a chargeback request on Monday or Tuesday next.
  • They are a UK company based in Northern Ireland

Ok forever is stretching it but still as far as customer service goes they are not exactly speedy fast.

£230 might seem like throw away money to some but to me it was a sizable purchase that means I am having to wait for my money in order to purchase the item else where.

Good to hear that charge back is pretty quick, will give that a go next week if I hear nothing from this company.

Have you not got a credit card?*
Make your new purchase using that - that will give you approx a month before you have to pay back the cc co.

*if not, you really should consider getting one - if only for the extra protection it gives.
  • I do have a few (and thats the problem) I quickly learnt I can't be trusted with them so try not to use them now the debt has all been sorted lol.

I know I should use them for online purchases and will think about doing just that after this episode. Never had an issue like this in online shopping. I am normally shocked at finding stuff arriving the next day when I was told 1-2 weeks :)

Do you mind me asking what the company is? I am in Northern Ireland and might be able to tell you whether or not I think it is a reputable company

Oh... there are plenty of threads on Nigel O'Hara, both on the Consumer Rights Board and on the Praise, Vents and Warnings Board.

    That dose't surprise me lol.

After I googled them I had that sinking heart feeling and was one of the reasons I requested the refund and also one of the reasons why I think raising it with my bank sooner rather than later might now be the best way.
  • I recently purchased a Dell laptop from Nigel O'Hara for £780. I have had similar experiences to you. It took ages for it to come and when I finally asked for a refund this was promised to me but a month later nothing has happened. Any e-mails I send are met with the same standard e-mails. If you read around you will see several similar stories. I am currently seeking the refund through my credit card company.
If I were you I would begin instigating whatever legal means you have because I wouldn,t hold out hope of them paying you without pressure on them

    Good Luck
