Help with bailiffs

Am not sure where to start,

I have missed quite a lot of council tax bills, over the years. I had arranged a payment plan with the council, but lost my job, last may.
I then missed a few payments in arrears, but went and made a new plan.
I started a temporary job in October which ran on till Christmas, and then I was out of work till may.
In that time I had 2 bailiffs come round , I told them I was out of work, and they just took my NI number, and told me to get in touch with the council. I did and they started taking money out of job seekers for the arrears.
When the second bailiff came around he said that the council haven't take me off the order. So I phoned them again and they said they will now a new plan is in place.

Since i started work may the 27th, I haven't made a payment as i don't get paid till the 25th. But i received a letter saying

"as you appear to be refusing to pay the above dept and have ignored previous communications we have called today to collect payment in full. As there was no reply we have left this final notice before removal action.
You must contact the bailiff in charge within 4 hours to make a payment in full"

The bill is for £952.49, i don't even get that in a months pay. I phoned the council as I don't understand how they have been to court. They said it is out of there hands.
I phoned the bailiff to make a payment plan, and he was having none of it. Said its all or nothing. I don't know what to do, as he is expecting £700 next week and the rest the week after. I also have rent to pay, as I am behind on that. Can anyone give me any advice.

    You need to ask the council as to whether they are taking the arrears via deductions from your JSA - its policy in my dept not to take accounts to bailiffs if we can get deductions.

    It may be that if you have multiple Liability Orders that only one is set up on JSA deductions.If you get no luck ask to speak to either a senior officer or a principal officer ( the next grade up above senior officer) to get this looked in to.

    Yes I am up todate, with it this year. But I do owe a few seperate bills, from different years. It just keeps building up.

  • If you were me...I would download this spreadsheet and see what you have left.Take the sheet to the council and have any extra payment added to this years council tax bill.

    This should get the council to call the bailiffs off.

    Remember to fill the form in the best you can and include all payments you can think of out.

    If you were me...I would download this spreadsheet and see what you have left.Take the sheet to the council and have any extra payment added to this years council tax bill.

    This should get the council to call the bailiffs off.

    The problem with that is that councils very rarely withdraw , its more likely that they would instruct the bailiff with regards to an arrangement. If its been issued correctly then most bailiffs will charge the councils to return the cases which is why its unlikely.

    Hi,I understand what you are saying.However,the council in my opinion would be foolish not to accept the offer if the amount would be inline with what a court would accept.And if petereverton had attended the court with this offer I couldn't see why it wouldn't be accepted.

    Its more a case of only having x amount left to pay the council rather than ignoring any offer to pay.We are after all dealing with council tax.

    The problem is that the only time a court rules on payment is if the case is sent for committal - at the liability order hearing the magistrate has power only to rule on your liability for the charge , nothing else.

    this sounds like a good idea I would go with this if you can't afford to pay the bill in full it shows that you are willing to pay after all and no one can fault that...good luck.. and don't let them in...:D

  • I spoke to the bailiff, and he reckons he can break in, and that he could also push past.
    He also said and I quote. "he wants his money" its not his but the councils.
    I have searched through my old mail, and can not find a letter saying we are due for a court hearing.
    The bailiffs company is Jacobs Certificated Bailiffs.
