I'm whiter than white with my credit but was recently rejected when i applied for a tesco credit card. i was advised that it was due to a credit search they did with experian.
I paid for a copy of the report and it contain one bad point. This is an error from Halifax saying i defaulted (status 8). I looked into what this meant and the experian guide explains the process it would have had to go through to get to this status. I called Halifax who has admitted it was completely their error and no such debt existed on this account. They also admit that no correspondense on this account ever ocurred! They have therefore deleted from my credit record.
I am miffed because i have spent 2 hrs on the phone to halifax, paid for 2 lots of credit reports to find the problem and ensure it's fixed. now i've got to go through a more lengthy process to re-apply to tesco and missed out on 4000 tesco points i would have got when i bought MFI stuff last week.
Have i any claim against Halifax for my cost incurred and losses due to their error or can they send out duff credit info without any liability?

I had this a few years ago when Black Horse put a default against my husband's name for a HP agreement he had never had with them.
Another customer with the exact same name, exact same year of birth but different month and day, defaulted on a HP agreement and then disappeared so they put a tracin g agent onto him, found my husband with the same name and then just went ahead and registered it against my husbands name.
They had sent my husband a letter "asking for the outstanding balance" so we got in touch with them and as soon as he told them his date of birth they said "oh sorry there has been a mistake you wont be contacted again" yet a few months later I applied for our credit record and saw the default on there for £9000!
In the meantime we had applied for a decent rate bank loan and been turned down so had to go to the associates! We applied to upgrade our bank account from normal to premier and got turned down and when we aplied for the credit file I saw why!
Experian were completely disinterested. I argued that they had a duty to me, the customer, to make sure the information they were bandying around was correct. As the date of birth was so flipping obviously not my husbands and the address was one we had never been linked to, I said they shouldn't have allowed the information to be put on but they just said it wasn;t their responsibility it was Black Horse.
Anyway Black Horse offered £50 compensation which I refused (as I had had to pay much more than that to the Associates for their huge interest loan!) so they upped it to £100 stating it was their final offer so I accepted it.
So yes, go ahead and complain!April 2006 - £9790.26dr. DFD - March 20110
