OR for Bristol County Court - what is she/he like?

I have set my BR date for 28/05, and i was just wondering if anyone had any experience of the OR(s?) for Bristol - i am hoping for nice!! My only concern is that i am hoping the OR will be persuaded not to inform my landlord - i have no arrears, and i'd hate to have to move. My tenancy doesn't mention bankruptcy at all...

    I did, indeed, have my OR meeting at the Bristol Office (even though my Bankruptcy was at the High Court in London).
    Mine was a 'face to face' interview, in their office - a short walk from Temple Meads Station.
    The interview was very thorough - lasted three hours - but was not at all officious or judgemental. I was offered coffee and was allowed a 'smoke break'.
    The questions were based around the form that they sent me and I had to sign a full statement at the end of it - I was even given a questionnaire which asked for my comments about what I thought of the interview.
    After the interview, and off record, we even discussed the rising number of insolvencies.
    Anyway - back to your case - I can not, obviously, say that the OR will definitely NOT contact your landlord - they have the right to inform a landlord of a tenant's bankruptcy, but, to be honest, I don't think that they do in every case - especially when that landlord is not one of the creditors who will be directly affected by your bankruptcy.
    I do, however, think that it would be a good idea to voice your concerns at your OR interview - the OR can adopt a degree of discretion and, anyway, it is NOT in the OR's interest, or volition, that you should suffer unnecessarily because of your bankruptcy. Unless you are paying an extremely high 'rent' for the area, then I can not imagine that the OR will be too concerned about your rental situation.
    Looking at it from your landlord's perspective - you say that you have no arrears and I would assume, from that, that you are a good tenant, and enjoy good relations with your landlord. Why, then, would he even want to throw you out? Your rental contract does not contain a clause excluding bankrupts so I would think that he would be on a pretty sticky wicket if he 'wanted' to evict you anyway.
    Your Bankruptcy is going to give you a fresh start. The OR is going to look at your Income/expenditure statement and will base any IPO/IPA on the 'surplus' income AFTER your basic needs, including rental, are paid for. You are no longer going to be chased by 'debt collectors' or have to 'rob Peter to pay Paul' so your rent is going to be pretty safe - as far as your landlord is concerned.
    So don't worry too much about the OR informing your landlord - by all means mention your pre-occupations at your OR meeting - whilst I can make no guarantees that the OR will definitely NOT tell your landlord, I can only say, based on my experience with the Bristol OR's office, that they were extremely pleasant with no apparent wish to cause any further 'anguish'.
    It is, of course, possible that your landlord is going to find out about your bankruptcy by reading about it in your local paper. Perhaps it might be worth considering telling him yourself - you might be pleasantly surprised by his reaction.

    Thanks, that makes me feel fairly reassured, although, for three hours i might have to start smoking just for the break!!

    I don't think the 'smoking' is obligatory, SHD, but a 'break' was certainly in order. :rotfl: :rotfl:

    Just bear in mind that my bankruptcy was 'Creditor Petitioned' and therefore a face to face interview is virtually always the norm. If your bankruptcy is 'Debtor Petitioned' you may be lucky and have a telephone interview, which shouldn't last anything like three hours.

    My OR had wrote a letter to my Landlord but was fine.

    SUN PREPAID| Limit £O - balance £800CR

  • Hi Sarah - i had to defer my BR because my baby was born too close to 28th, and i wasn't ready, so i am going for it next week instead, so fingers crossed it will be ok... Hope fri goes well!
