Incapacity benefit spouse

My husband claims incapacity benefit he has the old invalidity benefit, because he has been on it for a few years. I am being made redundant soon, can he claim for me and how much is it likely to be. Also if I take a part time job how much can I earn before it affects what he claims for me.

  • As we are talking about an Incapacity Benefit claim which has transitional protection from the previous Invalidity Benefit claim the details will need checking from your local Incapacity Benefit office.

    I expect you will find the Dependants Allowance for someone on  long-term Incapacity Benefit is £44.35 and that he will lose this amount if you earn more than £55.65 after certain deductions. (Income Tax, certain National Insurance contributions, half of any sum paid towards an occupational or personal pension, any relevant child care charges) remember payment in kind (cigarettes, groceries etc. wouldn't have to be declared)

    Do also check that he is not paying tax on either his transitionally protected IB or the dependancy allowance for you. Mistakes have been made if so if he's previously been taxed on his benefit money you're in for a windfall.

    No his benefit is not taxable and is not used inthe calculation for my sons student tuition fees, so I can still earn up to £55 per week and he can claim for me, well that does not sound too bad, perhaps I will try and get a part time job Thanks for the info

    Hi we are in the same situation as the above and wondered if things are still the same or has any changes been made and are the amounts still the same that i could claim for my wife and the amount she can earn ?
    I have been on incapacity and disability living allowance for at least 20 years due to long term disability

    hi im a bit confused by what you say above i thought incapacity benefit was a taxable benefit i pay tax on my payment as i claim for my oh as well should i be paying tax??

    people who were on incap then called invalidity benefit before 1995 did not have to pay tax on that benefit so got transional protection
