driving course fee in bankruptcy?

hi guys,

Another question! My friend has been caught for "driving without due care and attention" and has been summoned to court in March. She has been sent a letter stating that she can go on a course to improve her driving - if she does the course and passes then she wont have to go to court.
the question is this - the course costs £165 but she cannot afford it - so can she put it into her bankruptcy and still do the course? does anyone have any experience of this driving course? I dont know which thread to ask in so any advice would be helpful.

  • As far as I'm aware you can't put fines etc into a BR. I could be wrong however.

    I still don't reckon your friend could include it, but she could call/email the Insolvency Service and ask. You tend to get a better reply when emailing them, so I'd recommend that.

    there phone number and emails details are there.
    Is the car worth much? she may lose it or ahve to buy a cheaper car if it is.

    I would be very very surprised if it could be included as well. But it's worth asking.

    If you email the IS it can sometimes take several days to get a reply, but you will get one.

    I know this is not strictly a fine but for reference most 'fines' can't be included but 'penalty notices' can. It depends who issues them and whether they would go through the magistrates or county court for enforcement.
    Fines

    Any fine (as defined in the Magistrates Court Act 1980) imposed on a bankrupt for an offence is not provable . This includes parking fines and fines imposed as a result of criminal proceedings.

    Fixed penalty notices issued on behalf of a local authority, including those in relation to the London congestion charge, are not fines for this purpose. They should be treated as provable debts and will be released on discharge from bankruptcy.
