Tour Operator Overbooks Accommodation - HELP!

Hi there

I recently booked a holiday with the travel agent Yourholidays.com for a 7 day trip from tour operator Thomas Cook to sharm el sheik (leaving this sunday). Yourholidays.com called me yesterday and said thomas cook made a problem with the hotel (5*) booking and overbooked me, and hence will offer me another hotel for the stay. However, the hotel they were offering looked 3* (even though it claims to be a 5*) so I refused and stated that they should provide a hotel with a similar rating to what i had booked. She has since called back and said she will keep trying but Thomas Cook refuse to keep me in the original hotel because of the overbooking.

Please can you advise what I can do about this. By law do they have to provide the hotel booking as stated or can they insist I take a different hotel?

What can I do for this, bearing in mind its only a few days away before I'm scheduled to leave? Should I speak to Thomas Cook directly to resolve this (cant even get through on their phone lines because they're constantly engaged though)

Please help!

    There appear to be serious overbookings in many of the best hotels in Sharm at the moment. It seems the hotels are the cause, not the tour operators. Have a look at the alternative hotel on tripadvisor.com and see what it says, it might be better than you expect
  • Was also going to suggest trip advisor. I think your only real option is a refund or accept alternative.You would probably be entitled to compensation according to their cancellation rules. You may of course find something else elsewhere last minute?? if you took a refund.
