HMO wash hand basin rule to be amended

The prescriptive requirement for wash hand basins, bathrooms and toilets as specified in Schedule 3 to SI 2006/373 met with much concern from both landlords and local authorities.
Most local authorities wanted greater flexibility to adopt local standards, and to enable them to use their discretion, where they felt it was appropriate.
The new regulations, SI 1903 The Licensing and Management of Houses in Multiple Occupation (Additional Provisions) (England) Regulations 2007, were laid before Parliament on 10 July 2007 and are due to come into force on 1 October 2007.
Under the new regulations, there must be “an adequate number of bathrooms, toilets and wash hand basins suitable for personal washing for the number of persons sharing those facilities and where reasonably practical, there must be a wash hand basin with appropriate splashback in each unit other than a unit in which a sink has been provided as mentioned in paragraph 4(1)”.
