Completion day & old owners haven't moved out.

Hi, I'm looking for a bit of advice. My brother completed on his first house today. He had organised to collect the keys after work tonight, but has had a call saying that the old owners haven't moved out yet and he won't be able to collect the keys until lunchtime tomorrow. He is going to contact his solicitor first thing in the morning. What should he do? Any advice appreciated, I'd just like to put his mind at rest overnight.

He should have contacted his solicitor immediately he got that message. They would then contact the seller's solicitor to find out exactly what is happening.
Basically the sellers are in breach of contract, they have not provided the vacant possession required. The next legal move is to go to court to demand possession, there would also be a claim for necessary expenses incured (storage costs and a hotel for the night). When the solicitors speak hopefully the seller's solicitor will confirm that the sellers do intend vacating tomorrow and will meet out of pocket expenses without the need to go to court.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. My brother did try to contact his solicitor straight away, but they had already closed for the day. I guess we will have to see what happens tomorrow.0 -
