Buyer threatening civil court!!

I wonder if anybody can help.
This is what happened
First time I advertised a car on Ebay.No reserve with starting bid of £300. There is a dent/scratch on side of the car which I did not think was as serious as it is not that evident. As far as I was concerned looking at previous car auctions, I described it as a good runner, no rips or tears, took a few pics but never thought of taking specific pic of the dent/scratch.I did mention that the car was there to be inspected and test driven before bidding.I also mentioned that it was good for its age but did not make any comment about the exterior. The auction ended at £420.After chasing up the guy he said he will come to inspect and collect the car a week later which was agreed. He text me 2 hours later after the time it was agreed to let me know that he had been and had been appalled about the "accidental damage" on the car.He has appartently taken pics of the damage and would report to Ebay.He never responded to my text or phone calls.I reported the car as being unpaid to ebay.He has since responded and has described the car as "not as described " and has accused me of being "fraudulent and deceptive" He has threatened civil court action and wants reimbursement of insurance, travelling and his time!!!
As far as I am concerned I have advertised a car which was there to be viewed before bidding. It is certainly not a major dent/scratch and for £420 which with more than £100 worth of road tax is a total bargain.Other bidders asked me questions about the car which I honestly responded to and said it had some dents. But this guy never asked me anything and seemed that he came to collect a perfect car for £420. Its me who is shocked!!
Any advice much appreciated before I respond to him. Thanks

Whe he came to collect the car did he inspect it then? did you have a witness present to confirm it if you did? When you buy a car you fully inspect it so any damage you would see so why didn't he bring it up with you then? when other people asked questions did you have these open to see on the auction? sounds like he is being a plonker,

He hasn't even bought the car, though, has he? He can't sue you for breach of contract - the contract has not been completed if he's not paid.

In all honesty, he doesn't have a case. Sounds like a nutter to me, and you're probably best off not pandering to him.

He has not bought the car, he came to view the car at my home address but never spoke to me.Text me 2 hours later. He has not made a payment.
He has not responded to me personally but via a dispute through Ebay.
Thats what my impression was............. a complete nutter!!
No it was private emails that the other bidders sent to me.

Hi sorry to hear you are having problems - this guy is obviously just trying to make a few quid. Now that you have opened a dispute due to him not paying, he cannot claim against you as he has not actually completed the transaction. If within your listing you clearly stated that the car was avaialble for viewing before bidding and was in "good nick for its age" then the buyer really should have viewed the car before they bidded not after.

What I would suggest that you do is within the dispute thread there is the option to close the dispute and within there you will be given options to select as to why you wish to close the transaction. If you select he option that best suits your requirements and one that will refund your fees ie. we have both mutually agreed not to continue with the transaction then ebay will email the buyer and once he responds to it and agrees to it the dispute will be closed and you will get the fees back from ebay that you incurred in selling the car. However you wont get the listing fee back, you may get this back if, after the dispute has been closed you relist the item, but you will need to check for confirmation on this when you go to relist it ( it should be just under the section about the fee payable for listing on the confirmation to list page).

I hope this makes sense. This is only my opinion on what I would do - I am sure that some else will be along to give you more advice.
Oh nearly forgot if you do end up relisting it because this joker doesnt pay up then I would suggest that you add somewhere on the listing that the car does have a few minor bumps and dints as expected with a car of its age, and tell them to feel free to email you for more details.

I hope you resolve this matter
    Thanks Vicky
