Advice needed holiday from hell.

I was wondering if anyone could give me some advice on my holiday from hell. Me and my OH booked a holiday to majorca with UK travel shop for 1 week from the 19th of August to the 27th, for 1 thousand pounds. We booked an all inclusive holiday at the hotel ola bermudas in Palma Nova. It all started going wrong when we never recieved any confirmation details eg the flight details, which terminal we were flying to and from, the airline company, and the desk to pick the tickets up from. When we arrived at the hotel at 4.30 am we went to reception to book in, and was told that the hotel had been fully booked by mistake and that they had booked us a replacement hotel the don bigote 3 mins down the road. Anyway we booked in and when we got to our room it was half the size of the room we originaly booked, with not as much facilities as we booked. The don bigote was half board and we paid for all inclusive. we booked the hotel ola bermudas because it was a small quiet hotel with 200 rooms all inclusive which was what we wanted, but the hotel they moved us to had 720 rooms and was noisy. The next day we went to see the manager of the hotel ola bermudas to complain. He said there is no way he could get us into the hotel as they were fully booked even though that was the hotel we booked, he then said we could go over to the hotel for our drinks so it would be all inclusive with the half board we were staying at. He then tried to offer us a trip spending all day on a coach as compensation only if we would sign a form to say that we would accept the trip as compensation, we declined and never set foot in the hotel for the remainder of our holiday as the whole point of being all inclusive is we should not have to keep coming back and forth between hotels. We rang our tour operator uk travel and there rep said they would get in touch with the manager of the hotel bermudas and see if they could move us back in and they said no. So the rep said he would try and get us into an all inclusive hotel and get back in touch with us the next day but he never did. We never heard off anyone for the rest of the holiday. I also got food poisoning from the meals we had at the half board hotel we stayed at. To cut a long story short have we got any rights? I would be grateful if anyone could give me some advice thank you.

If the travel shop you booked with is ABTA approved then put your grievances in a letter to them as per "complaining" guidelines here: http://www.abta.com/benefits.html
If they were not ABTA approved then, first off lesson learned about booking from non regulated travel agents, but also write much the same letter to the tour operator. Also check the T's & C's for your booking, they may have clauses to excuse the fact your chosen hotel was not available but none the less not getting the features you paid for should be covered.
At the very least I think you can expect a partial refund or goodwill payment.
As for the food poisoning, I sympathise but it's likely to be ignored as so many holiday makers succombe to it.
These days I holiday in the UK, just as nice, without the bother.0 -
Wow do you have a case,and not a suit case ,a legal case,they failed to provide you with the goods you paid for as advertised,I would take multi action ,the regulator that they are registered with ,and a legal action in the small claims court ,trouble is this might not be small,and of course trading standards,you sound very spirited so you will have no problem[FONT=Arial, Helvetica, sans-serif]To be happy you need to make someone happy.[/FONT]0

Good luck with your action the advice is good they did not provide what you paid for and by contacting the rep you have complied with their T's and C's they just chose not to rectify the situation which can only strengthen your claim for compensation.:beer:0
