What do I do now?

Bit worried now.

Long story short. LL property manager is who we have been dealing with. No estate agent as initial agent done a bunk with rent etc.

Paid £800 deposit. was told LL would cover it as agent done bunk with money handed to him from our property and others too. Have email stating TDS would hold deposit and would recieve certificate, Never did. Have spoken to TDS and the two other agencies who have no record anything was or is held with them.

Moved out of property 1st Nov, inspection was carried out by an independant inspection agency on 3rd Nov. Report brought up issues with paint work and one stain in carpet. Agreed to pay £80 to have room repainted (even though we repainted the day before with the paint LL gave but it dried a diff colour hence repainting again).

Have had emails stating about pieces of a chair which doesn't have a back on but this is down to the fact the fitting has no screw holes so cannot be fitted. Part is in house and all needs to be done is replaced by IKEA.

It has been three weeks now and we have still not had our deposit back dispite us completing our end of the deal and sending copies of final bills etc.

I'm now considering going down the legal route. I have emailed tonight asking for copy of certificate and copy of inspection report so I can raise a dispute with the deposit scheme. I'm 100% sure it's not in a scheme as I've called them and nothing there and was told that they can't release the funds unless there is an agreement from both sides?

What is my inital step and how do I go about this? HELP!

    Have no idea from your post who you are dealing with or what documentation you have. What is "LL property manager "?
    "was told LL would cover it " by who? Why? if agent has done a bunk with LLs cash that's not your problem. (I assume you have a signed contract? and receipt for the deposit? - fine, Landlord must repay you.)
    What about deposit registration? Deposit taken what date? Lodged with which scheme?
    "an independant inspection agency " appointed by who?

    As G-M says your post is not that clear to other people. Was there an inventory in place at the start? Were you checked in to the property by an independent inventory clerk? How can you "raise a dispute with the deposit scheme" if you are "100% sure" your deposit is not registered with any of them? Whether or not the scheme folk have agreement from both sides is irrelevant if your deposit has not in fact been registered.

    My suggestion would be to get written confirmation from each of the 3 schemes: TDS, DPS and mydeposits Then, if definitely no registration in place, write to your LL recorded delivery (keep a copy) . Give the address of the property , the dates of the tenancy, the amount of the deposit and when it was paid. State that the LL has failed to scheme register your deposit, as required under the Housing Act 2004 , which has deprived you of the possibility of arbitration on the deposit return. Say that if you do not receive the return of your deposit in full within 10 working days it is your intention to pursue the matter to court to include a claim for the deposit return, plus the penalty payment of 3x the deposit amount, plus court costs.
  • Our LL (call him A) has several properties which are dealt with by B who manages his portfolio. We found the property through C agency. That agent didn't give complete an inventory, and turned out he had done a bunk with rent and deposits. A and B took C down the small claims court and we dealt with B from this point on. B sent us an email that A would cover the deposit and would transfer it into a scheme so we would not lose out.

    We have a copy of the contract we had, although we have no reciepts that the deposit was paid to C we have bank statements showing we transferred it to C's account, and I have the emails from where B stated A would be placing our deposit in a scheme.
