Ebay item not as described!

I bought a microwave described as ex display, just as new. Now it hasn't been used but the stainless steel has lots of scratches which were not mentioned in the listing. Also the package it came in was packed out with allsorts, catfood boxing, beer boxing, magazines, all of it moved greatly in transit so the box was damaged each side where the microwave hit it, and it dented during transit on one side and will be seen when fitted. He is saying he can fix it as he has spare parts but where do I stand, packaging was terrible and I've been told to make sure I package well when I return it. I know it's at my cost but do I then get a refund, and can I not have it back? I thought if there were any marks on it they had to say! Thanks.

A good seller will pay for return postage but they do not have do. Technically if they are a business they have to but getting it out of them is another thing
I think you need to decide what you want. If what the seller has offered you do not agree with you need to tell him what you wish to do. Do you want the MW repaired and returned to you or the refund? If you want it repaired go with his offer but ask about the return postage.
Personally from your description I would want a refund and to take my money elsewhere
You need to return it to him by an online trackable method so if there are problems and you have to open a paypal claim you can prove its been returned0 -

Have just checked and it seems that company that he used for delivery say that microwaves are deemed as whitegoods and restricted for their services and therefore are sent at their own risk and not covered, I'm being told to use them for return, what do I do?Too many children, too little time!!!0

I'd use paypal dispute for returning rather than dealing direct with the seller, just for transparency more than anything.Did you know you can get Viagra software now??? Yeah, it turns your floppy drive into a hard drive0

Ok, one step further, as advised by someone else I've requested the return via ebay, funnily enough after ignoring emails all day he approved my request within 5 minutes!
What I can't workout is who pays for postage, on the help pages it says business sellers are liable due to distance selling laws and the damage, unless they state when you buy. But on the item page it says by the item description, returns accepted, then when I click for details it says no returns???Too many children, too little time!!!0
